网络虚拟人格保护的困境与前路

【摘要】:我国《民法总则》首次确立了数据和虚拟财产的客体地位,但网络虚拟人格的固有部分保护容易被忽略。在个人网店的名誉被侵害的情况下,通常只能主张经营者个人的名誉权受到了侵害。至于游戏人物的虚拟人格的名誉以及操作游戏的自然人的名誉,在特定的能够识别并将二者联系起来的群体中,可看作是重合的;在其他情况下,二者被视为不同客体,也就是说,对于上述名誉的侵害,视为一个侵权行为侵害了不同的客体。网络虚拟人格的保护方式有二种:一是把虚拟人格归为虚拟财产,从而使虚拟人格被自然人人格吸收,这也是目前《民法总则》体现的保护方法;二是承认虚拟人格的准人格性,让虚拟人格和自然人人格一定程度分离,在虚拟人格商业化过程中弱化其人格属性。

As for the reputation of the virtual personality of the character of the game and the reputation of the natural person who operates the game, it can be seen as overlapping in a particular group that can identify and associate the two; in other cases, the two are considered different objects, In other words, the above-mentioned reputation infringement, as a tort against different objects. There are two ways to protect the network virtual personality: one is to classify the virtual personality as virtual property, so that the virtual personality is absorbed by the personality of natural person, which is also the protection method embodied in the General principles of Civil Law at present; The other is to recognize the quasi-personality of the virtual personality, to separate the virtual personality from the natural personality to a certain extent, and to weaken its personality attribute in the process of the commercialization of the virtual personality.
