集体所有权的法典化命运及其中国实践

【摘要】：集体所有权在大陆法系传统国家面临着理论上的困境,集体所有权的内在逻辑结构和理念与传统的民法典体系是不相容的,因而民法法典化国家均放弃了集体所有权。集体所有权在我国的立法确认是历史的必然,用罗马法传统的所有权观念和欧陆国家民法法典化的经验来对我国的集体所有权进行评价,不符合我国的客观国情,而且改革的成本过于高昂。未来我国应该继续坚持农村土地的集体所有,并顺应农业发展和农民需求,通过制定农民利益类型化的立法,使得集体所有权的改革与农民的土地权利要求相适应,确保在城镇化的进程中集体经济成员的利益实现。
[Abstract]:Collective ownership is facing a theoretical dilemma in the traditional countries of the continental law system. The inherent logical structure and concept of collective ownership are incompatible with the traditional civil code system, so the civil law codification countries have given up collective ownership. The confirmation of collective ownership in China's legislation is a historical necessity. It is not in line with the objective conditions of our country to evaluate the collective ownership of our country by using the traditional concept of ownership of Roman law and the experience of codification of the civil law of European countries. And the cost of reform is too high. In the future, China should continue to adhere to the collective ownership of rural land, comply with the development of agriculture and farmers' needs, through the formulation of farmers' interest type legislation, so that the reform of collective ownership and farmers' land rights to adapt to the requirements. Ensure that the interests of collective economic members are realized in the process of urbanization.
