综艺节目著作权保护的二元视角分析

【摘要】：综艺节目侵权的话题近年来持续升温,但业界对其侵权的态度却莫衷一是。笔者认为,对待综艺节目的保护可以尝试从综艺节目影像与综艺节目版式两个维度进行讨论。对综艺节目影像而言,可以类比文学艺术作品中关于剽窃的认定,坚持"先部分、后整体、看比例、问大众"的原则。对待节目版式,可以尝试认定独创性高的版式为汇编作品,而对独创性相对低一些的可以尝试增设一项专门保护节目版式制作者的邻接权来保护其权利。
[Abstract]:Variety show tort topics in recent years continue to heat up, but the industry on its infringement attitude is not unanimous. The author thinks that the protection of variety show can be discussed from two dimensions of variety show image and variety program layout. To the variety show video, we can compare the recognition of plagiarism in literary and artistic works, adhere to the principle of "first part, then whole, see proportion, ask the public" principle. For the program layout, we can try to identify the original layout as the compilation works, while for the relatively low originality, we can try to add a special protection program layout producer's neighboring right to protect its rights.
