高校职务发明奖酬法律问题研究

【摘要】:高校职务发明活动相校于企业而言具有相对的独立性,应当优先体现我国职务发明制度从"集体本位"到"个人本位"的理念转变。广义的高校职务发明奖酬包括给予发明人及技术转移人员两类主体的经济报酬。我国《专利法》及其实施细则、《促进科技成果转化法》、《职务发明条例(草案)》等对于职务发明奖酬的规定可以适用于高校,需要在解决法律适用优先次序、拓展奖酬涉及的职务发明范围及提高奖酬标准等方面予以改进。高校技术转移服务人员的贡献应当得到肯定,并且赋予其获得奖酬的法定权利,从而对其给予有效的激励。
[Abstract]:There is relative independence in the activities of job invention in colleges and universities, so we should give priority to the transformation of the concept of "collective standard" to "individual standard" in the system of job invention in our country. The broad sense of college job inventor award includes two kinds of economic reward to inventor and technology transfer personnel. The Patent Law of China and its implementing rules, the Law on the Promotion of Scientific and technological achievements, the regulations on Job Invention (draft), etc., which can be applied to colleges and universities, need to give priority to the application of the law. Expand the scope of job invention and improve the standard of reward. The contribution of technical transfer service personnel in colleges and universities should be recognized, and the legal right to receive awards and remuneration should be given to them, thus giving them effective incentives.
