论建筑物区分所有权专有部分和共有部分的划分标准

【摘要】:自从建筑物区分所有权的出现,我国理论界就对其进行关注,并且在后来的立法界中确定下来,此时与建筑物区分所有权有关的理论研究就浩如烟海,但是,在实践过程中,建筑物区分所有权制度仍然无法完全解决实务的诸多问题,如存在激烈争议的小区停车位问题,会所架空层,等建筑物权属的问题,正是因为这些争议才会引起了社会矛盾,所以急需解决这些问题。本文主要根据建筑物区分所有权中的专有部分和共有部分划分标准来入手,因为,正是划分标准的不明确,才会引起相关问题。本文的主要研究路径,首先,对建筑物区分所有权的相关理论进行阐述,主要是对专有权和共有权进行比较分析,其次,是列举出建筑物区分所有权中专有权和共有权冲突中所出现的相关问题,然后,在针对各国的专有部分和共有部分相关法律规定,进行比较分析,比较出哪些适合借鉴于我国建筑物区分所有权专有部分和共有部分划分标准,最后,针对我国建筑物区分所有权专有部分和共有部分应该从哪几方面入手,其中的主要目的是解决我国在建筑区分所有权中所存在的实务问题
[Abstract]:Since the emergence of the division of ownership of buildings, the theoretical circle of our country has paid close attention to it, and it has been determined in the later legislative circles. At this time, the theoretical research on the ownership of buildings is vast. However, in the process of practice, there is a great deal of research on the theory of division of ownership of buildings. The system of division of ownership of buildings is still unable to completely solve many practical problems, such as the problem of parking spaces in intensely disputed residential areas, the empty floors of the buildings, and so on. It is precisely because of these disputes that the social conflicts will be caused. So there is an urgent need to solve these problems. This paper is mainly based on the division standard of exclusive part and common part in the division of building ownership, because it is the unclear division standard that will lead to the related problems. The main research paths of this paper are as follows: firstly, the related theories of building division ownership are expounded, mainly the comparative analysis of exclusive rights and co-ownership rights, and the second is to make a comparative analysis of the exclusive rights and the co-ownership rights. Is to enumerate the related problems arising in the conflict of exclusive and shared rights in the division of ownership of buildings, and then to make a comparative analysis of the relevant legal provisions in respect of exclusive and shared parts of the country, This paper compares what is suitable to draw lessons from the division of proprietary part and common part of building in our country. Finally, which aspects should we start with in view of the division of proprietary part and common part of building in our country? The main purpose of which is to solve the practical problems existing in the division of ownership of architecture in our country.
