网络信息在现有技术抗辩认定中的证据适用

【摘要】：专利侵权案件中现有技术抗辩的对比对象应是被控技术特征与现有技术,但不应当忽视专利文件在对比过程具有的参考价值与辅助意义。网络信息在作为现有技术抗辩证据的过程中存在诸多难点,例如证据类型、证据的真实性以及是否构成专利法意义上的公开等问题。对此有必要从网络信息的证明标准、证据类型、证据来源以及收集程序方面明确网络信息在现有技术抗辩认定中的采信规则。
[Abstract]:In patent infringement cases, the object of contrast should be the features of the accused technology and the existing technology, but the reference value and auxiliary significance of the patent documents in the contrast process should not be ignored. There are many difficulties in the process of network information as evidence in defense of existing technology, such as the type of evidence, the authenticity of evidence and whether it is open in the sense of patent law. It is necessary to clarify the rules of acceptance of network information in the identification of technical defences from the aspects of the standard of proof, the type of evidence, the source of evidence and the collection procedure.
