民法典的理想与现实

【摘要】：正民法典作为市民社会的用户指南,其意义远非"一部成文法典"所能概括。那些在不同历史时期诞生的伟大民法典,无不承载着厚重的历史使命。不难想见,对于自觉归入大陆法系的中国而言,拥有一部民法典,既是愿景,更是心结。八十多年前,吴经熊先生在《新民法和民族主义》一文中无比自豪地欢呼:"此后中国已为有《民法典》的国家了,这是在法制史上何等重要,何等光荣的一页!"时移世易,社会主义中国也将在新世纪迎来自己的民法典,几代学人的梦想竟然不经意就
[Abstract]:As a user's guide to civil society, the meaning of the Civil Code is far beyond that of a written Code. The great civil codes, which were born in different historical periods, carry a heavy historical mission. It is not difficult to imagine that for China, which consciously belongs to the civil law system, having a civil code is not only a vision, but also a conclusion. More than 80 years ago, Mr. Wu Jing-bear cheered with great pride in his article "New Civil Law and nationalism": "since then, China has become a country with the Civil Code. This is a page of great importance and glory in the history of the rule of law!" When times change, socialist China will also usher in its own civil code in the new century, and the dreams of several generations of scholars have unexpectedly inadvertently made use of it.
