城镇化中宅基地置换补偿问题研究

【摘要】:随着中国城镇化的不断发展,城镇化进程的不断加快,各地为了适应城镇化的发展,纷纷推行宅基地置换政策。宅基地置不仅关系国家建设、经济发展,同样也是农民根本利益所在。在各地宅基地置换进程中,侵犯失地农民利益的现象也不乏出现。本文对我国现阶段城镇化中宅基地置换补偿问题进行研究,不仅对宅基地置换补偿法律制度的完善提供了一定的帮助,为宅基地置换实践中的补偿提供更多科学合理的依据,同样也为畅通失地农民权利救济渠道提供借鉴意义,使失地农民合法利益得到保护,巩固党的群众基础。本文从城镇化、宅基地制度、宅基地置换制度为切入点,分析了我国城镇化的发展趋势与问题所在,对我国宅基地制度发展历程做了简要的总结与分析,研究了宅基地置换制度的法律内涵和现实意义。本文重点探讨了宅基地置换补偿问题,对其法学本质和补偿模式进行了简要分析,同时总结并提出其现存法律规范中存在的一系列问题。最后通过对美国、日本相关法律研究借鉴,从实体法和程序法两个方面对城镇化中的宅基地置换补偿问题进项研究。就实体法方面而言,现阶段宅基地置换补偿缺乏统一的法律规范,各地方政府自行制定地方性法规来加以规定和执行,公正性得到质疑。在程序法方面,由于缺乏实体法的统一规范,在宅基地置换补偿的整个过程中,程序不合法现象普遍,而最为严重的便是缺乏公众的参与,公告程序和听证程序流于形式。在宅基地置换补偿中,很多地方失地农民的合法权利得不到有效的保护,这不仅是民生建设的大事,也影响到社会稳定。为此,笔者认为制定统一的宅基地置换补偿的法律规范已刻不容缓只有这样才能不断实现实体公正和程序公正,这不仅有利于保障失地农民的合法权利,也有助于我国法律体系的不断完善,推动法治社会的发展。
[Abstract]:With the continuous development of urbanization in China and the acceleration of urbanization process, in order to adapt to the development of urbanization, various localities have promoted the policy of land replacement. Homestead is not only related to national construction, economic development, but also the fundamental interests of farmers. In the process of homestead replacement, the phenomenon of violating the interests of land-lost farmers also appears. This paper studies the compensation of homestead replacement in the current urbanization of our country, which not only provides some help to perfect the legal system of homestead replacement compensation, but also provides more scientific and reasonable basis for the practice of homestead replacement compensation. It also provides reference for the relief channel of land lost farmers' rights, so that the legitimate interests of lost land farmers can be protected, and the mass foundation of the Party can be consolidated. From the perspective of urbanization, homestead system and homestead replacement system, this paper analyzes the development trend and problems of China's urbanization, and makes a brief summary and analysis of the development process of China's homestead system. This paper studies the legal connotation and practical significance of the house land replacement system. This paper focuses on the compensation for homestead replacement, briefly analyzes its legal nature and compensation mode, and sums up and puts forward a series of problems existing in its existing legal norms. Finally, through the relevant legal research of the United States and Japan, from the substantive law and procedural law to study the compensation for homestead replacement in urbanization. As far as the substantive law is concerned, the compensation for homestead replacement is lack of uniform legal norms at present, and local governments make local laws and regulations to regulate and implement them themselves, and the fairness of compensation is questioned. In the aspect of procedural law, due to the lack of unified norms of substantive law, in the whole process of compensation for homestead replacement, the illegality of the procedure is common, and the most serious is the lack of public participation, the announcement procedure and the hearing procedure are merely formal. In the compensation of homestead replacement, the legal rights of landless farmers in many places cannot be effectively protected, which is not only a great event in the construction of people's livelihood, but also has an impact on social stability. Therefore, the author believes that it is urgent to formulate a unified legal norm of compensation for the replacement of homestead. Only in this way can substantive justice and procedural justice be continuously realized, which is not only conducive to the protection of the legitimate rights of farmers who have lost their land. It is also conducive to the continuous improvement of our legal system and promote the development of the rule of law society.
