校园欺凌问题的困境解构与法律破解——以美国反欺凌立法为借鉴范式

【摘要】:校园欺凌事件的愈加频发暴露出我国在预防与应对校园欺凌方面的诸多不足:以普遍化的宣传教育为主要预防手段,立法层面的规范制度指导有余而监督不足,在欺凌事件发生后校方应对措施并不积极与及时,使得校园欺凌往往止步于个案解决的层面,其他社会主体也难有适当的平台发挥其应有的参与及监督作用。未来的完善之路可参照美国的成熟经验,以反校园欺凌立法为依托,确立欺凌的立法定义、欺凌事件报告制度及各主体责任,以使欺凌事件可以被及时有效予以甄别,并通过校方、家长、社会等主体的共同合力,将其消极危害降到最低。
[Abstract]:The increasing incidence of campus bullying has exposed many deficiencies in the prevention and response to campus bullying in our country: universal publicity and education as the main means of prevention, the legislative level of the normative system more than guidance and inadequate supervision, After the bullying incident, the school's countermeasures are not active and timely, which makes the campus bullying often stop at the level of case resolution, and it is difficult for other social subjects to have an appropriate platform to play their due role in participation and supervision. The road to perfection in the future can refer to the mature experience of the United States, rely on the anti-campus bullying legislation as the basis, establish the legislative definition of bullying, the bullying incident reporting system and the main responsibility of each body, so that bullying incidents can be screened in a timely and effective manner. And through the school authorities, parents, society and other main forces together, to minimize its negative harm.
