复审中依职权引入创造性等明显实质性缺陷的案例适用分析

【摘要】：在复审程序中,合议组审查范围的界定是复审工作的难点之一。其中,对于案件中存在的复审请求范围外的缺陷,合议组是否可依职权进行审查也是日渐成为复审请求人与合议组,甚至法院的争议焦点。本文通过对几个案例的分析,希望能改进对于是否可依职权审查明显实质性缺陷的考量方法。
[Abstract]:In the review procedure, the definition of the scope of the collegiate group review is one of the difficulties in the review work. Among them, for the defects outside the scope of the review request in the case, whether the collegiate group can examine it ex officio is also becoming the focus of controversy between the review petitioner and the collegiate group, and even the court. Through the analysis of several cases, this paper hopes to improve the method of considering whether the obvious substantial defects can be examined ex officio.
