知识产权的物权化思考

【摘要】：知识产权与物权既有不同的特征,又具有共性。知识产权因其客体的非物质性,导致了其具有不同物体的特性,在知识产权的私权化过程中,不断呈现出知识产权与物权在权利归属中的作用、知识产权支配的内容增强、知识产权的排他性扩张等一些物权化的现状。其主要有三方面的因素决定:一是知识产权私有财产价值的增强;二是知识产权客体范围的扩张;三是知识产权与物权的相互作用。知识产权的物权化是知识产权私权价值的体现,也是知识产权私权化的演进。
[Abstract]:Intellectual property rights and real rights have not only different characteristics, but also common. Because of the immateriality of its objects, intellectual property rights have different characteristics of objects. In the process of private ownership of intellectual property rights, the functions of intellectual property and real rights in the ownership of rights are constantly presented, and the content of intellectual property rights is strengthened. The exclusive expansion of intellectual property rights and some other property rights of the status quo. It is mainly determined by three factors: one is the enhancement of the value of private property of intellectual property; the other is the expansion of the scope of object of intellectual property; the third is the interaction between intellectual property and real right. The property right of intellectual property is the embodiment of the private right value of intellectual property right, and also the evolution of the private right of intellectual property right.
