转基因植物新品种的专利权限制保护研究

【摘要】：各种转基因产品不断走进大众的视野,特别是转基因食品渐渐渗透到人们的餐桌,不管你愿不愿意,它都来了,我们对转基因食品问题最核心的也是最重要的关注点就是安全与否,转基因食品的上游产品---转基因植物品种的风险是否可控,转基因食品是否存在重大的安全隐患,还有转基因产品所涉及的伦理、文化冲突等等问题。那么用来生产转基因食品的转基因植物种子,其中不乏是跨国公司巨额投入经过多年而研发出来的,对于这些转基因植物新品种要不要保护以及以何种形式进行保护成为当下我们面临的一个棘手、复杂又现实的难题。转基因给消费者和社会都带来了很多的负面影响,国际上和国内对待转基因是采取价值取向各有所重点,但是这些转基因食品最终间接或是直接被端到餐桌,该如何保障我们消费者的合法权益,我们应该采取一种什么样的举措才合情合理,在法治的框架下又不至于顾此失彼,即抓住了机会又能把副作用降到最低限度?转基因技术在走向市场的产业化之前,消费者的生命健康权怎样才能得到保护,我们的立法者应该制定出一部什么样的法律法规让转基因生物产品既有安全保证,又能让消费者生命健康权利得到保护,让人的发明创造热情得到最大的激励,让生物技术得到应有的进步,让人类社会的文明进步得以持续发展,历久弥新。
[Abstract]:All kinds of genetically modified products continue to enter the public's field of vision, especially genetically modified food gradually infiltrates people's table, whether you like it or not, it is coming. Our core and most important concern about genetically modified food is whether it is safe or not, whether the risk of genetically modified plant varieties, the upstream product of genetically modified food, can be controlled, and whether there are major safety risks in genetically modified food. There are also genetically modified products involved in ethics, cultural conflict and so on. Well, there are many genetically modified plant seeds used to produce genetically modified food, many of which have been developed by multinational corporations after years of huge investment. Whether or not these new transgenic plant varieties should be protected and what form of protection we are facing has become a thorny, complex and realistic problem. Genetically modified genes have brought a lot of negative effects to consumers and society. The international and domestic treatment of genetically modified genes is focused on the value orientation, but these genetically modified foods are ultimately indirectly or directly brought to the table. How can we protect the legitimate rights and interests of our consumers? what kind of measures should we take in order to be reasonable and reasonable?. Under the framework of the rule of law, we should not lose sight of one or the other, that is, we can seize the opportunity and minimize the side effects. Before the industrialization of genetically modified technology, how can consumers' right to life and health be protected? what kind of laws and regulations should our lawmakers formulate to ensure the safety of genetically modified biological products? It can also protect consumers' right to life and health, encourage people's enthusiasm for invention and creation, make biotechnology make due progress, and make the progress of civilization of human society develop continuously and renew for a long time.
