表达自由权在版权制度中的实现——以网络戏仿作品版权纠纷为视角

【摘要】：表达自由权属于基本人权的范畴。版权与表达自由始终是一对矛盾,版权与表达自由之间具有非常复杂的辩证关系,版权制度既可以促进表达自由,也可能阻碍表达自由。随着现代信息传播技术的飞速发展,版权对表达自由的妨碍作用日益突出。比如,网络戏仿作品使用了他人作品,有可能被认定为侵权。但戏仿这种创作方式是作品创作的重要形式,从表达自由权的角度而言,应该得到允许。作品不是禁区,不但作者有权使用作品,读者也有权使用作品,读者对作品的诠释也是一种创造,是表达自由权的实现。版权制度应当从过度扩张,阻碍表达自由和公共文化创作的迷雾中走出来,通过修改版权合理使用的相关条款,保障社会公众的表达自由权,实现激励作品创作,促进文化繁荣的最终目标。
[Abstract]:The right to freedom of expression belongs to the category of fundamental human rights. Copyright and freedom of expression are always a pair of contradictions. There is a very complex dialectical relationship between copyright and freedom of expression. Copyright system can not only promote freedom of expression, but also hinder freedom of expression. With the rapid development of modern information communication technology, copyright plays an increasingly important role in hindering freedom of expression. For example, online parody works use other people's works, may be recognized as infringement. However, parody is an important form of creation, which should be allowed from the point of view of the right to freedom of expression. The work is not restricted area, not only the author has the right to use the work, the reader also has the right to use the work, the reader's interpretation of the work is also a kind of creation, is the realization of the right to freedom of expression. The copyright system should come out of the fog of excessive expansion, hindering the freedom of expression and the creation of public culture. By modifying the relevant provisions of the rational use of copyright, the right to freedom of expression of the public can be guaranteed, and the ultimate goal of encouraging the creation of works and promoting cultural prosperity should be realized.
