上海自贸区金融消费者保护的调解机制

【摘要】：上海自贸区金融业的扩大开放使得为金融消费者提供倾斜保护的需要更为紧迫。但是,现阶段我国在立法上尚未确立"金融消费者"的法律地位,尚未建立保护金融消费者的专门制度。在金融纠纷解决方面,有必要借鉴英国、新加坡和香港这些发达的国际金融中心的金融消费者保护调解制度,以建设上海自贸区为契机,构建起对金融消费者提供倾斜保护的强制调解机制。
[Abstract]:With the expansion and opening up of the financial industry in Shanghai Free Trade Zone, the need to provide inclined protection for financial consumers is more urgent. However, at present, China has not yet established the legal status of "financial consumer" in legislation, and has not yet established a special system to protect financial consumers. In the aspect of financial dispute resolution, it is necessary to draw lessons from the financial consumer protection and mediation system of the developed international financial centers such as Britain, Singapore and Hong Kong, and take the construction of Shanghai Free Trade Zone as an opportunity to construct a compulsory mediation mechanism to provide preferential protection to financial consumers.
