我国海上保险保证制度研究

【摘要】：2015年英国保险法的修订对全球保险立法和保险实践将产生较大的影响,特别是其中的保险保证制度,相较于旧的立法有了较大的变化。尽管我国参照英国保险法的规定引入了“保证”制度,但仅在《海商法》第二百三十五条有所规定,显得简单粗略,立法的简单导致保证制度在我国的应用性不强,难以解决实务中遇到的很多问题,必须完善之。本文借英国保险法对保证制度修改之契机,纵向概述海上保险保证制度的基本内容、基本类型及其存在的重要性,并介绍其在我国的立法和实践现状,找出我国存在的实际问题;再横向比较保证制度在不同国家海上保险业的发展状况,探求该制度在英美法中发展的客观规律,充分借鉴国外立法和司法实践经验,来修缮我国海上保险保证制度,从而为我国海事法院审理海事案件、正确解决海上保险纠纷提供指导和借鉴。因此,本文的重点内容将是围绕我国海上保险保证制度的现状及问题,在国外的相关制度的启示下,就如何明确我国保证制度的内涵,如何设置限制保险人适用保证的条款以及如何保护被保险人利益等问题进行展开。本文共分为四章,包括:第一章是概述海上保险保证制度所包含的内容以及存在的重要性。本章主要包括:海上保险保证制度的含义、内容、类型、以及其存在的重要性等内容。第二章是介绍我国海上保险保证制度的现状及存在的问题。本章主要探讨我国海上保险保证的立法现状、我国海上保险保证的实践现状,以及基于现状剖析出我国相关法律法的不足之处。第三章是国际海上保险保证制度的分析及启示。本章主要从普通法系国家、大陆法系国家二个角度分析保证制度,并比较分析二个法系国家制度优势,总结出对完善我国海上保险保证制度的启示。第四章是针对我国海上保险保证制度存在的问题提出可行性的建议。本章立足于我国海上保险保证制度的现状及不足,通过分析国际海上保险保证制度可借鉴之处,试图从保证的定义、内容、主体等方面完善我国相关法律制度。
[Abstract]:In 2015, the amendment of the British Insurance Law will have a great impact on the global insurance legislation and insurance practice, especially the insurance security system. Although our country introduced the "guarantee" system by reference to the provisions of the British Insurance Law, it is very simple to stipulate only in Article 235th of the Maritime Code. The simplicity of legislation leads to the weak application of the guarantee system in our country, so it is difficult to solve many problems encountered in practice, which must be perfected. This paper summarizes the basic contents, basic types and the importance of the marine insurance guarantee system, and introduces its legislation and practice in our country, and finds out the practical problems in our country. Then compare the development of the guarantee system in different countries in different countries, explore the objective law of the development of the system in the common law, fully learn from the experience of foreign legislation and judicial practice, to repair the marine insurance guarantee system of our country. Therefore, the main content of this paper will focus on the current situation and problems of marine insurance guarantee system in China. Under the enlightenment of the relevant systems abroad, this article is divided into four chapters: how to make clear the connotation of the guarantee system in our country, how to set up the clauses restricting the insurer to apply the guarantee and how to protect the interests of the insured. The first chapter is an overview of the content of the marine insurance security system and the importance of its existence. This chapter mainly includes: the meaning, content, type of the marine insurance security system. The second chapter is to introduce the current situation and existing problems of marine insurance guarantee system in China. This chapter mainly discusses the legislation status of marine insurance guarantee in our country, the practice status of marine insurance guarantee in our country. The third chapter is the analysis and inspiration of the international marine insurance guarantee system. This chapter mainly analyzes the guarantee system from the common law countries and the civil law countries. And comparative analysis of the institutional advantages of the two legal system countries, This chapter summarizes the enlightenment to perfect the marine insurance guarantee system of our country. Chapter 4th is to put forward the feasible suggestion in view of the problems existing in the marine insurance guarantee system of our country. This chapter is based on the present situation and the insufficiency of the marine insurance guarantee system of our country. Based on the analysis of the international marine insurance guarantee system, the author tries to perfect the relevant legal system of our country from the definition, content, subject and so on.
