海事赔偿责任限制责任主体研究

【摘要】: 本文以《1976年海事赔偿责任限制公约》和我国《海商法》的相关规定为背景,针对海事赔偿责任限制制度下的责任主体的相关问题,结合航运和司法实践,运用历史分析、案例分析、立法比较的方法进行研究。通过对英美国家的主要理论观点的分析,对各责任主体的涵义作出界定。同时通过对《1924年关于统一海运船舶所有人责任限制若干法律规定的国际公约》、《1957年船舶所有人责任限制的国际公约》和《1976年海事赔偿责任限制公约》发展演变过程的研究,得出责任主体享有责任限制的法理基础。并在此基础之上,提出了应当限制责任主体范围的想法,最后提出对我国《海商法》的相关修改建议。 全文共分为四个章节:第一章通过研究大陆法系和英美法系的早期立法,对海事赔偿责任限制制度的产生及发展沿革进行阐述;第二章针对责任主体的演变过程,探讨责任主体享有责任限制的法理基础;第三章通过对上述三个国际公约的历史背景分析,分别研究各责任主体的立法背景,并结合相关概念对各责任主体的涵义进行界定;最后一章在前文的研究基础之上,并比较英国、美国、加拿大、俄罗斯等国家的相关立法,讨论责任主体的未来发展趋势,并提出笔者的观点和立法建议。 通过本文的研究,笔者得出以下几点结论:(1)海事赔偿责任限制制度的产生是基于遵循共同冒险事业的原则、考虑高昂的货物价值、公司有限制度的产生及促进航运业的发展等立法理由;(2)现今,海事赔偿责任限制制度下的责任主体享有责任限制的法理基础是基于其对船舶的经营或收益;(3)今后应对海事赔偿责任限制制度下的责任主体范围维持现状,不宜扩大。
[Abstract]:Based on the relevant provisions of the Convention on limitation of liability for Maritime claims of 1976 and the relevant provisions of Maritime Law of China, this paper applies historical analysis to the relevant problems of the subject of liability under the limitation system of liability for maritime claims, combined with shipping and judicial practice. Case study, legislative comparison method. Through the analysis of the main theoretical viewpoints of the Anglo-American countries, Definition of the meaning of each subject of responsibility... at the same time, the adoption of the International Convention of 1924 on the Unification of certain legal provisions on the limitation of the liability of Marine owners, the International Convention of 1957 on the limitation of the liability of ship owners and the < 1976 Maritime claims. Study on the evolution of the Convention on limitation of liability, On the basis of this, the author puts forward the idea that the scope of liability subject should be limited, and finally puts forward some suggestions to amend the Maritime Law of our country. The full text is divided into four chapters: the first chapter through the study of the civil law system and the common law system of the early legislation, the emergence and development of liability limitation system for maritime claims are elaborated; the second chapter is aimed at the evolution of the subject of liability. The third chapter analyzes the historical background of the above three international conventions, studies the legislative background of each responsibility subject, and defines the meaning of each responsibility subject in combination with relevant concepts. The last chapter is based on the previous research, and compares the relevant legislation of Britain, the United States, Canada, Russia and other countries, discusses the future development trend of the subject of responsibility, and puts forward the author's views and legislative suggestions. Through the study of this paper, the author draws the following conclusions: 1) the system of limitation of liability for maritime claims is based on the principle of common venture and the consideration of high value of goods. The emergence of the limited system of companies and the promotion of the development of the shipping industry, and other legislative reasons. The legal basis of the liability subject under the limitation system of maritime claim liability is based on its operation or profit to the ship) the scope of the liability subject under the limitation system of maritime claim liability should be maintained in the present situation and should not be expanded.
