【摘要】： 最大诚信原则是海上保险法的重要法律特征，，保险人能否遵循最大诚信原则、切实履行最大诚信义务成为保险业良性发展的重要保证。本文旨在对海上保险人的最大诚信义务问题进行较为深入、系统的研究，以引起学术界对这一课题的重视，为实务界和司法界提供理论参考。为此，作者以最大诚信原则基本理论为基础，对保险人的最大诚信义务内容、适用、违反的法律后果等一系列重要理论问题进行了研究；对几种典型的保险人最大诚信义务，包括保险人告知义务、保险人对格式合同尤其免责条款的说明义务、通知义务、投保人迟延缴纳保险费时保险人的最大诚信义务及保险人在理赔过程中的最大诚信义务进行了探讨；并对我国保险立法中上述相关规定提出了质疑。在此基础上，作者对《保险法》和《海商法》相关内容提出修改建议，并对保险人实务操作中出现的问题提出解决办法。
[Abstract]:The principle of maximum good faith is an important legal feature of marine insurance law, and whether the insurer can follow the principle of maximum good faith, The purpose of this paper is to make a deep and systematic study on the problem of the maximum good faith obligation of the marine insurers, in order to arouse the academic attention to this subject. To provide theoretical reference for the practical and judicial circles. Therefore, on the basis of the basic theory of the principle of maximum good faith, the author studies a series of important theoretical issues such as the content, application, legal consequences of breach of the insurer's maximum good faith obligation, and makes a study of several typical types of insurer's greatest good faith obligation. Including the obligation of the insurer to inform, the obligation of the insurer to explain and notify the form contract, especially the exemption clause, This paper probes into the maximum bona fide obligation of the insurer and the maximum bona fide obligation of the insurer in the process of settling claims when the insured delays the payment of the insurance premium, and questions the above relevant provisions in the insurance legislation of our country. The author puts forward some suggestions to amend the relevant contents of Insurance Law and Maritime Law, and puts forward some solutions to the problems in practical operation of insurers.
