《鹿特丹规则》下承运人交货义务研究

【摘要】: 货物交付是海上货物运输下承运人承担的重要义务,也是货物运输合同的主要目的,往往导致货物运输合同的终结。尽管货物交付是海上货物运输中的关键一环,但在《鹿特丹规则》之前的国际公约,如《海牙规则》、《汉堡规则》当中,对承运人交货义务的规定比较零散,在很多问题的规定上存在很多空白和不足,很难就货物交付为航运实践和司法审判提供足够指引。《鹿特丹规则》首次作为一个调整海上货物运输的国际公约,对货物交付问题进行了全面细致、系统详尽的规定,为航运实践中货物交付问题的处理提供了依据,除此,《鹿特丹规则》针对航运实践中就货物交付经常出现的一些问题提出了创新的解决方法,弥补了现行国际公约的不足。从这些方面看,《鹿特丹规则》所具有的积极意义是不言而喻的,然而任何一个国际公约的产生都是多方利益相互调和的结果,在这一过程中,必然会牺牲某些利益方的利益,这就导致这一国际公约在实际操作中会产生一些难以预料的问题,《鹿特丹规则》当然也不例外。 本文立足《鹿特丹规则》第九章关于货物交付的规定,共分为五章。第1章介绍了货物交付的基本概念、类型,以及它的历史沿革。第2章详细分析了《鹿特丹规则》下承运人在签发不同类型的运输单证或者电子运输记录时具体的交货义务,以及控制权对承运人交货义务的影响。第3章介绍了《鹿特丹规则》有关无单放货问题的创新规定。第4章阐述了《鹿特丹规则》下承运人遭遇交货受阻时的权利义务。第5章是对《鹿特丹规则》关于货物交付规定的评价以及对我国《海商法》的借鉴。 作者希望通过本文的研究,进一步明确《鹿特丹规则》关于货物交付规定的积极意义以及不足之处,以对我国《海商法》的完善有所裨益,并能够为航运实践提供理论依据。
[Abstract]:Delivery of goods is an important obligation assumed by the carrier under carriage of goods by sea and the main purpose of a contract of carriage of goods, often leading to the termination of a contract of carriage of goods, although delivery of goods is a key link in the carriage of goods by sea. However, in the international conventions before the Rotterdam rules, such as the Hague rules and the Hamburg rules, the provisions on the carrier's obligation to deliver goods are relatively fragmented, and there are many gaps and deficiencies in the provisions on many issues. It is difficult to provide sufficient guidance on the delivery of goods for shipping practice and judicial trials. For the first time, the Rotterdam rules, as an international convention regulating the carriage of goods by sea, provide comprehensive, detailed and systematic provisions on the delivery of goods, It provides the basis for handling the problem of goods delivery in shipping practice. In addition, the Rotterdam rules provide innovative solutions to some problems that often arise in shipping practice. From these aspects, the positive significance of the Rotterdam rules is self-evident. However, the emergence of any international convention is the result of the reconciliation of various interests, and in this process, It is inevitable that the interests of some stakeholders will be sacrificed, which will lead to some unpredictable problems in the practical operation of this international convention, and the Rotterdam rules are no exception. Based on the provisions of Chapter 9th of the Rotterdam rules on the delivery of goods, this paper is divided into five chapters. Chapter 1 introduces the basic concepts and types of delivery of goods. Chapter 2 analyzes in detail the specific delivery obligations of carriers when issuing different types of transport documents or electronic transport records under the Rotterdam rules, Chapter 3 introduces the innovative provisions of the Rotterdam rules on the delivery of goods without documents. Chapter 4 expounds the rights of the carrier when the delivery of goods is blocked under the Rotterdam rules. Chapter 5 is the evaluation of the provisions of the Rotterdam rules on the delivery of goods and the reference to the Maritime Law of China. The author hopes to further clarify the positive significance and deficiencies of the Rotterdam rules on the delivery of goods through the study of this paper, so as to be of benefit to the perfection of Maritime Law of China and to provide theoretical basis for shipping practice.
