民国时期留美生中国法律问题研究的海外影响——以留美生博士论文为中心的考察

【摘要】：民国时期,留美生撰写了20多篇有关中国法律问题研究的博士论文,涉及与中国相关的国际法问题、民商法问题、中国宪法问题等。其中,相当一批论文在海外公开出版或发表,有的多次再版;一些论文被海外学术界同行所引用或评论,充分肯定了其选题价值、文献价值和研究内容的学术贡献,彰显了留美法学学人通过中国法律问题研究与西方学术界平等对话的努力与成效,及中国法学学术的进步。
[Abstract]:During the Republic of China, students in the United States wrote more than 20 doctoral theses on Chinese legal issues, covering issues related to China's international law, civil and commercial law, China's constitution, and so on. Quite a number of papers have been published or published overseas, and some have been republished many times; some papers have been cited or commented by their counterparts in overseas academic circles, fully affirming the value of their selected topics, the value of literature and the academic contributions of their research contents. It demonstrates the efforts and effects of the scholars in the United States on the equal dialogue with the western academic circles through the study of Chinese legal issues, as well as the progress of the Chinese legal science.
