【摘要】:随着世界贸易和科技的不断发展,危险品涉及的领域不断增多,在各个国家的经济发展、科学研究以及贸易往来中均有危险品的存在。作为海上运输领域的一个重要组成部分,危险货物运输的特殊性在航运界和海商法理论界一直倍受关注。承运人不仅要运送无危险的货物,还要运输有风险的货物,托运人既要承担货物毁损的结果,还要承担对承运人或第三方造成的人身伤亡、货物毁损的责任。在什么情况下由谁承担什么样的责任,承担多少,在我国《海商法》中规定的略显单薄。因此,承托双方法律责任的划界问题更是成为一直以来的研究热点。 本文从海上危险货物运输中有关承托双方法律责任的相关立法入手,通过理论分析、比较分析、实证分析和图表分析等方法将研究的总体框架置于危险货物承托双方责任划分的理论与实践分析中,进而明确托运人和承运人在危险货物运输中的法律地位以及特殊权利、义务;研究危货托运人、承运人责任承担的理论基础,同时借鉴航运发达国家的权威判例得出说服力极强的归责原则;并根据相关义务划分责任承担的具体内容,最后结合了有关危险货物运输的国际公约、世界各地和地区有关海上货物运输的相关立法,将提出的比较全面的有关危险货物承托双方责任的具体内容,形成于法律条文的修改中去。 本文希望通过对危险货物承托双方权利义务以及责任的全面梳理,进一步明确危险货物承托双方的责任划界问题,对各自应该承担的责任作出详细规定,形成于具有明确性和可操作性的法律条文,使责任的承担更趋于合理化,以保障海上危险货物运输安全,促进海上危险货物运输的健康发展。
[Abstract]:With the continuous development of world trade and science and technology, dangerous goods are involved in more and more fields. There are dangerous goods in the economic development, scientific research and trade of all countries. As an important part of the field of maritime transport, The particularity of the transport of dangerous goods has been paid much attention to by the shipping and maritime law theorists. The carrier not only carries the goods without danger, but also carries the goods at risk, and the shipper should bear the result of the damage of the goods. Also bear the responsibility of personal injury or injury to the carrier or a third party, damage to the goods. Under what circumstances, who will bear what kind of responsibility, how much, in our country "maritime law" stipulated a little thin. Therefore, The delimitation of legal liability between the two parties has been a hot research topic all the time. This paper begins with the relevant legislation on the legal liability of both parties involved in the carriage of dangerous goods by sea, through theoretical analysis, comparative analysis, The methods of empirical analysis and chart analysis put the overall framework of the study in the theoretical and practical analysis of the division of the liability of the parties to the dangerous goods, and then clarify the legal status and special rights of the shipper and the carrier in the transport of dangerous goods. Obligations; studying the theoretical basis of carrier's liability, and drawing lessons from the authoritative jurisprudence of developed countries to draw a persuasive imputation principle; and dividing the specific content of liability according to the relevant obligations, Finally, combining the international conventions on the transport of dangerous goods and the relevant legislation on the carriage of goods by sea in various parts of the world and regions, it will put forward more comprehensive and specific contents concerning the liability of both parties to the transport of dangerous goods. Formed by the amendment of the law. This paper hopes that through a comprehensive review of the rights, obligations and responsibilities of both parties to the transport of dangerous goods, it will further clarify the delimitation of the responsibilities of both parties, and make detailed provisions on their respective responsibilities. It is formed by the clear and operable legal provisions, which makes the responsibility more reasonable, in order to ensure the safety of the transport of dangerous goods by sea and promote the healthy development of the transport of dangerous goods by sea.
