电子商务立法若干问题研究

【摘要】：电子商务是当今世界知识经济迅猛发展的象征,是经济全球化和信息网络化的产物,电子商务的快速发展已经成为世界经济发展的新动力,各国政府都致力于建立和完善能促进本国电子商务发展的支撑体系,以应对经济全球化挑战,把握本国经济发展的主动权。法律法规建设是电子商务发展的重要方面,世界范围内的电子商务立法呈现出快速、趋同、协调、开放等特点。我国的电子商务立法活动也已经开始,这是促进我国电子商务发展、转变我国经济增长方式、贯彻科学发展观的必然要求。本文在介绍电子商务发展现状的基础上评述和分析了国际电子商务立法的现状,阐述了我国电子商务立法的必要性,并在研究我国电子商务立法的基本原则、价值取向以及法律定位、基本特点的基础上,给出了我国电子商务法的基本内容和框架。
[Abstract]:E-commerce is the symbol of the rapid development of knowledge economy in the world, and the product of economic globalization and information networking. The rapid development of E-commerce has become a new motive force for the development of the world economy. The governments of all countries are committed to establishing and perfecting the supporting system that can promote the development of electronic commerce in their own country, in order to meet the challenge of economic globalization and grasp the initiative of their own economic development. The construction of laws and regulations is an important aspect of the development of electronic commerce. E-commerce legislation in the world shows the characteristics of rapidity, convergence, coordination and openness. The legislative activities of e-commerce in China have also begun, which is to promote the development of e-commerce in our country and to change the mode of economic growth in our country. On the basis of introducing the present situation of the development of electronic commerce, this paper reviews and analyzes the present situation of the international legislation on electronic commerce, and expounds the necessity of the legislation of electronic commerce in our country. On the basis of studying the basic principles, value orientation, legal orientation and basic characteristics of our country's e-commerce legislation, the basic contents and framework of our country's e-commerce law are given.
