【摘要】: 船舶是海上运输的工具,作为一种具有特殊功能和用途的物,调整海上运输关系和船舶关系的海商法需要对以船舶为客体的物权作出特别规定,因此,船舶物权制度作为海商法的基本制度之一,具有十分重要的意义。船舶担保物权制度是船舶物权制度的重要内容,我国《海商法》关于船舶担保物权制度的立法虽体现了国际上物权立法的先进发展趋势,但也存在着一定的缺陷。本文从船舶抵押权、船舶优先权和船舶留置权三种船舶担保物权形式入手,通过对各国海商法律和国际公约的冲突比较,提出解决法律冲突的一些途径与方法,旨在为进一步完善我国《海商法》中有关船舶担保物权的某些规定提出理论依据和具体建议。
[Abstract]:As an object with special functions and uses, the maritime law which adjusts the maritime transport relationship and the ship relationship needs to make special provisions on the real right of the ship as the object. As one of the basic systems of maritime law, ship real right system is of great significance. Although the legislation of maritime law of our country about the real right system of ship security reflects the advanced development trend of international real right legislation, it also has some defects. Through the comparison of the conflicts between the maritime laws and international conventions of various countries, this paper puts forward some ways and methods to resolve the conflicts of law, starting with the three forms of security interest in ships, maritime lien and maritime lien. The purpose of this paper is to put forward theoretical basis and concrete suggestions for the further improvement of some provisions in Maritime Law of China concerning security interests in ships.
