【摘要】:本文从船舶优先权最基本的概念、特征以及设立目的入手,讨论与之相关的船舶优先权的优先顺位问题。船舶优先权作为海商法中重要的特有制度,其优先顺位问题在理论和实践上都具有极高的研究价值。 第一章从船舶优先权的概念和法律特征入手,进而探究船舶优先权制度设立的目的以及研究船舶优先权优先受偿顺位问题的重要意义,是本篇论文的基础部分,为后文中对船舶优先权的各种优先顺位问题研究做好铺垫。 第二章主要研究船舶优先权的内部受偿顺位问题。该部分阐述了法律为某些特定海事请求设置船舶优先权的主要原则,并提出了笔者对相关问题的思考和建议,认为应当在我国海商法中引入“航次原则”,对船舶优先权担保的各海事请求依航段予以划分,进而具体规定各船舶优先权担保的海事请求的优先顺位。 第三章研究的主要内容是船舶优先权与其他船舶担保物权问的优先顺位关系。笔者认为我国《海商法》规定船舶优先权较船舶抵押权具有更高的优先受偿顺位是合理的,而笼统的规定船舶留置权后于船舶优先权得到受偿需要再次斟酌,海损事故后、为继续航行所必须的修船费用请求应当具有更高的受偿顺位。 第四章主要研究船舶优先权制度与海事赔偿责任限制制度问的优先顺位关系。笔者认为,应当调整船舶优先权担保的限制性债权在设置责任限制基金后的行使方式,并建议对船舶优先权担保的非限制性债权在责任限制基金分配后的受偿方式,通过立法进行进一步的明确。 第五章讨论的是船舶优先权在航运企业破产中的优先受偿。笔者认为船舶优先权基于政策的、公益的原因,对某些特定海事请求进行保护,以促进航运业的健康有序发展,区别于其他破产债权,其在破产程序中就船舶优先受偿有其充分依据。 最后本篇论文最后的总结部分,将对整篇论文的研究作出归纳性结论,对船舶优先权相关的各优先受偿顺位问题进一步阐述,得出自己的结论和建议。
[Abstract]:Starting with the most basic concept, characteristics and purpose of establishment of maritime liens, this paper discusses the priority order of maritime liens, which is an important special system in maritime law. The priority sequence problem is of great value in both theory and practice. The first chapter starts with the concept and legal characteristics of maritime lien, and then probes into the purpose of the establishment of maritime lien system and the significance of studying the priority of maritime lien. It is the basic part of this paper. This paper lays the groundwork for the research of priority sequence of maritime liens. The second chapter mainly studies the internal compensation order of maritime liens. This part expounds the main principles of establishing maritime liens for certain specific maritime claims, and puts forward the author's thoughts and suggestions on the related issues. It is considered that "voyage principle" should be introduced into the maritime law of our country, and each maritime claim of maritime lien guarantee should be divided according to the section, and then the priority of maritime claim secured by maritime lien should be specified. The main content of the third chapter is the priority relation between maritime liens and other ship security interests. The author thinks that it is reasonable to stipulate that maritime liens have higher priority order than ship mortgage. But the general stipulation after the ship lien obtains the compensation after the maritime lien needs to consider again, after the average accident, the ship repair expense request which is necessary for the continuation of navigation should have a higher order of compensation. The fourth chapter mainly studies the priority relation between maritime lien system and limitation system of maritime claim liability. The author thinks that the way of exercising restrictive creditor's rights of maritime lien guarantee should be adjusted after the establishment of liability limitation fund. It is also suggested that the way of payment of the unrestricted claims of maritime lien security after the allocation of the liability limitation fund should be further clarified by legislation. The fifth chapter discusses the priority of maritime liens in the bankruptcy of shipping enterprises. The author thinks that maritime liens are based on policy and public good reasons to protect certain specific maritime claims in order to promote the healthy and orderly development of shipping industry. Different from other bankruptcy claims, there is sufficient basis for the prior payment of ships in bankruptcy proceedings. In the last part of this paper, the conclusion of the whole paper is summarized, and the priority priority of maritime liens is further elaborated, and their own conclusions and suggestions are obtained.
