关于船舶融资租凭合同若干问题的法律研究

【摘要】： 本文从融资租赁的定义和种类入手，通过与光船租赁、一般融资租赁相比较，显示船舶融资租赁交易独特的法律性质、法律特征。在我国现有法律体系下，分析船舶融资租赁的法律适用，指出我国目前船舶融资法律方面的空白和不足。主要在《合同法》第十四章和比照适用《海商法》，中光船租赁合同相关条款的法律框架下，具体研究船舶融资租赁合同的订立、效力、主要内容、双方当事人权利义务、对第三者的责任等，从而拟订出一种可操作性强的船舶融资租赁格式合同。本文也对船舶融资租赁的风险保障机制和登记制度进行了初步探讨，提出若干法律建议。
[Abstract]:This paper begins with the definition and types of financial lease, and shows the unique legal nature and legal characteristics of ship financing lease transaction by comparing it with bareboat lease and general financial lease.Under the existing legal system of our country, this paper analyzes the legal application of ship financing lease, and points out the gaps and deficiencies in the legal aspects of ship financing in our country at present.Mainly under the legal framework of Chapter 14 of the contract Law and the application of the Maritime Law by comparison with the relevant provisions of the Zhongguang ship charter contract, the conclusion, validity, main content, rights and obligations of the parties concerned are studied in detail.The third party liability, so as to draw up a strong maneuverability of ship financing leasing format contract.This paper also discusses the risk protection mechanism and registration system of ship financing lease, and puts forward some legal suggestions.
