英文原版商法教材中的连贯策略初探

【摘要】:随着中国各高校积极推行双语教学,英文原版商法教材在中国高校中得到越来越广泛的应用。但是因为这些教材原本是为母语为英语的学生编写的,中国学生在理解这些原版教材时遇到不少问题。 在编写和使用教材的过程中,由于作者和读者的身份背景不同,他们的关系是不平等的。作者是这个领域的专家,而读者对此领域却知之甚少。为了帮助读者更好地理解教材内容,作者会在教材中使用一些连贯策略。 本研究的目的是通过分析英文原版商法教材中的三个连贯策略,说明作者是如何在教材中构建一个连贯的商法知识体系的。这三个连贯策略是预示种类(Predictive Categories)、主题结构(topic structure)和信息结构(information structure)。其中预设种类又包括列举(Enumeration)、提前标示(Advance Labeling)、转述(Reporting)、回顾(Recapitulation)、假设(Hypotheticality)和提问(Question)。 本研究分析了英文原版商法教材作者在教材叙述过程中采用的宏观和微观的连贯策略,旨在帮助读者辨别这些策略,了解它们构建连贯的方式和作用,从而更好地理解教材内容。本研究提出了一个新的语篇连贯框架,用于分析所选英文原版商法教材所选章节中的连贯现象。在这个框架中,预示种类通过提出预示和实现预示把不同层次的概念联系起来,从而构建一个宏观层级结构。主题结构可以通过单句主题(sentential topic)和次话语主题(subtopic)在宏观和微观两个层面起到连贯作用。旧信息→新信息的信息模式可以实现最微观层面上的连贯。 研究中选用的文本为清华大学和北京大学出版的两本工商管理硕士影印教材《商法—企业的法律、道德与国际环境》和《国际商法》中的五个章节,包括从《商法—企业的法律、道德与国际环境》中选择的三章和从《国际商法》中选择的两章。 主体研究部分分别对所选章节中的预示种类、主题结构和信息结构进行了辨别,并分析了它们在实现文本连贯中的作用。研究发现预示种类,特别是列举和提前标示在所选章节中非常普遍。预示种类通过提出预示和实现预示把不同层次的概念联系起来,从而为整个章节构建一个宏观层级结构,给读者一个宏观印象。主题结构在句子层面和篇章层面对文本的连贯都起作用。单句主题之间的语义联系可以使文本在微观层面上连贯,而次话语主题之间的联系,以及次话语主题和话语主题(discourse topic)之间的联系可以在更近宏观的层面上达到连贯。旧信息→新信息的信息模式可以实现最微观层面上的连贯。旧信息为理解新信息提供了必要的背景知识。 对所选章节的分析表明,这三种连贯策略在英文原版商法教材中确实存在,它们确实对文章的连贯起到了一定的作用。通过辨别、分析这三个连贯策略,读者可以更好地理解英文原版商法教材的内容。
[Abstract]:With the China universities actively promote bilingual teaching, English original business law textbooks used more and more widely in China universities. But because these materials originally intended for native English speaking students, Chinese students encountered many problems in understanding these original materials.
In the process of writing and using textbooks, the author and the reader due to different background, their relationship is not equal. The author is an expert in this field, and readers in this field are poorly understood. In order to help the readers better understand the text, the author will use some coherence strategies in the textbooks.
The purpose of this study is through the analysis of the original English commercial law textbooks three coherence strategies that the author is how to construct a coherent law knowledge system in the textbooks. These three coherence strategies (Predictive, Categories) indicates that the types of theme structure and information structure (topic structure) (information structure). The default types include list (Enumeration), mark (Advance Labeling), early reporting, review (Reporting) (Recapitulation) (Hypotheticality), assumptions and questions (Question).
This study analyzes the English original business law textbooks author in the narrative of teaching material used in the process of macro and micro coherence strategies, these strategies to help readers identify, understand their construction mode and effect of coherence, so as to better understand the teaching materials. This study proposes a new framework for the analysis of discourse coherence, selected English the original business law textbooks selected sections of the coherence phenomenon. In this framework, put forward and realize the prediction indicates different concepts through predictive categories, in order to build a macro level structure. The theme structure through the sentence (sentential topic) and the theme of discourse theme (subtopic) to the coherent effect in two the macro and micro level. The old model, the new information information information can achieve the most micro level coherence.
The text studies for the Tsinghua University and the Peking University published the two MBA textbook Photocopying commercial enterprise law ", the five chapter ethical and international environment of International Commercial Law > > and < < the law from the enterprise law, the three chapter moral choice and the international environment and select from < > International Commercial Law > in chapter two.
The main research part of the selected species indicates in the chapter, the thematic structure and information structure is identified and analyzed them in text coherence effect. Research findings indicate species, especially the enumeration and advance labeling is very common in the selected chapters. That kind of paper that indicates the different implementation and the concept of link level, in order to build a macro level structure for the entire chapter, give the reader a macro impression. The topic structure face text coherence function in the sentence level and discourse level. The semantic relationship between the topic sentences can make the text on the micro level of coherence, and between discourse theme links and the discourse theme and discourse theme (discourse topic) between the contact can be closer in the macro level to coherence. The old information to new information model information can achieve the most The old information provides the necessary background knowledge for the understanding of the new information.
Analysis of selected sections showed that these three coherence strategies do exist in the original English law textbooks, they do contribute to the coherence to a certain extent. Through the identification, analysis of these three coherence strategies, the readers can have a better understanding of the original English commercial law teaching material.
