【摘要】: 限制性损害赔偿责任是指在民事损害赔偿责任中,依据法律规定,损害赔偿责任人只在一定限额范围内承担的金钱赔偿责任。 限制性损害赔偿责任是一个既老又新的研究课题。说其老,原因在于早在一千多年前,其已经闯入了我们的生活;说其新,原因在于在过去的一千多年中,其无时无刻不在更新和拓展,同时目前对其不同种类做统一性研究的课题比较少,以此为角度具有新意。这就是在本文绪论中明了的一些背景内容。 第一章为限制性损害赔偿责任概论。本章通过详细讲述限制性损害赔偿责任的概念、特征以及与类似概念的比较来界定什么是本文所讨论的研究对象,从而构建本文研究的平台。 第二章为限制性损害赔偿责任现状论。本部分以第一章为基础,详细搜寻了历史发展中产生的各个不同类型的限制性损害赔偿责任。从海商法上的海事赔偿责任限制、承运人责任限制、船舶油污损害赔偿责任限制、港口经营人赔偿责任限制,到海商法外的航空损害赔偿责任限制、铁路运输损害赔偿责任限制、邮政运输损害赔偿责任限制、核损害赔偿责任限制、国家损害赔偿责任限制。这些限制性损害赔偿责任展现了其蒸蒸日上且错综复杂的发展轨迹。 第三章为限制性损害责任本体论。本部分是在第二章的基础上,详细抽象概括出限制性损害赔偿责任的一般规律。这些一般规律包括:限制性损害赔偿责任的构成、属性、分类及限制方法。这也是本文研究的阶段性成果之一。 第四章为限制性损害赔偿责任功能价值论。本部分的描述寻找限制性损害赔偿责任存在的理由,在于具有重大的社会功能和价值。同时,限制性损害赔偿责任并非万能的制度,其也存在缺陷,因此如何克服和弥补缺陷也是该制度发挥功能作用的关键所在。 在结论部分,笔者对文章本论做了一个简短的总结,并对我国未来限制性损害赔偿责任的立法构建提出几点建议。 全文虽有四万余言,但由于内容庞杂,资料欠缺及笔者水平有限,倍感空洞和浅显,这有待于各位学者仁人的批评指正以及笔者自身今后的进一步努力。
[Abstract]:Restrictive damage compensation liability refers to the civil liability for damages in accordance with the law, the money compensation responsibility for damages only undertaken within a certain amount.
The limit of liability of damages is both an old and new topic. The reason is that the old said, as early as one thousand years ago, it has intruded into our lives; the new reason is that, in the past one thousand years, it is not in every hour and moment to update and expand, and the different do the unity of research is relatively small, this angle is new. This is the content of this article in the introduction of some of the background.
The first chapter is the introduction to restrictive liability for damages. This chapter describes the concept of limited liability by the damage characteristics and compared with similar concepts to define what is the research object of this paper is discussed, in order to build the research platform for this paper.
The second chapter is on the liability status of restrictive damage. In this part, the first chapter as the foundation, with the search for the historical development of the different types of limitation of liability for damages. From the limitation of liability for maritime claims in maritime law, the limitation of liability for oil pollution damage, the limitation of liability, liability limitation of port operator to aviation, maritime law damage outside the limits of liability, limitation of liability for damage to the railway transportation, the limitation of liability of postal transportation damage, the limitation of liability for nuclear damage, limitation of liability for state damage. These restrictive liability for damages on the upgrade and show its perplexing development path.
The third chapter is the limitation of liability for damage ontology. This part is based on the second chapter, with abstract generalization of general rules of limitation of liability for damage. Including these general rules: restrictive damage compensation liability, property, classification and restriction method. It is also one of the research achievements.
The fourth chapter is on the function of liability value restriction damage. This part of the description for limited liability for damages exist, is of great social function and value. At the same time, the compensation system is not a panacea limited damage, it also has many defects, so the key is how to overcome the defects of the system to play and make up function.
In the conclusion part, the author makes a brief summary of this thesis, and puts forward some suggestions on China's future restrictive compensation responsibility legislation construction.
This paper has more than forty thousand words, but because the content is complex, the lack of data and the limited level of the author, feel empty and shallow, the scholars of benevolence criticism and author's further efforts in the future.
