国际货物多式联运单据法律问题研究

【摘要】：随着集装箱运输的发展,国际货物多式联运在经济发展中的地位越来越重要。但是1980年《联合国国际多式联运公约》的生效遥遥无期,1991年《联合国贸发会/国际商会多式联运单证规则》又不强制适用,导致国际上至今没有一部生效的公约调整多式联运的法律问题,这极大地制约了国际货物多式联运的发展。我国《海商法》和《合同法》虽然对此作了规定,但仍显单薄,不够完善,有待改进。多式联运单据在国际货物多式联运中,无疑扮演着非常重要的角色,但是对于国际多式联运单据,国际上至今也没有一部强制适用的公约/法规,我国对多式联运单据的研究还不很深入,这也造成在国际多式联运中,单据纠纷多有发生, 而对于纠纷的解决,又往往无法可依。本文从各单式运输单据的历史、发展入手, 对比单式运输单据的的功能和性质,分析了多式联运单据的功能和性质;分别分析研究了可转让多式联运单据和不可转让多式联运单据的性质和作用;并列举了目前国际上通用的几种国际多式联运单据的格式、条款,通过几种格式单据的比较,归纳总结了多式联运单据条款的特点及作用,同时列举了几种常见的多式联运单据中的问题条款;本文还结合多式联运的实践,比较了联运提单与多式联运单据的异同,并分析了UCP500对多式联运单据的规定,对于实践中经常出现的单据纠纷,本文也进行了细致的分析,并提出了自己的看法及相关的立法建议。希望文中提到的相关问题能够本文对国际多式联运的法律完善,以及国际多式联运的实践,能够有所帮助。
[Abstract]:With the development of container transportation, international multimodal transport of goods plays an increasingly important role in economic development.But the entry into force of the 1980 United Nations Convention on International Multimodal Transport is far from clear.The rules on multimodal transport documents of the International Chamber of Commerce (ICC) were not applied in a mandatory manner, resulting in the fact that no one has yet entered into force at the international level.The Convention regulates the legal issues of multimodal transport, which greatly restricts the development of international multimodal transport of goods.ChinaAlthough the Maritime Law and contract Law provide for this, they are still weak and imperfect, and need to be improved.Multimodal transport documents undoubtedly play a very important role in international multimodal transport of goods.In the international multimodal transport documents, there is not a mandatory convention / regulations in the international, our country to multimodalThe study of intermodal transport documents is not very thorough, which also results in many disputes over documents in international multimodal transport.And for the settlement of disputes, and often can not be relied on.This paper starts with the history and development of each single transport document.By comparing the functions and properties of single transport documents, the functions and properties of multimodal transport documents are analyzed.The nature and role of negotiable multimodal transport documents and non-negotiable multimodal transport documents are studied.The form, terms, and ratio of several international multimodal transport documents currently commonly used in the worldIn this paper, the characteristics and functions of the multimodal transport document clauses are summarized, and several common multimodal couplings are listed.This paper also compares the bill of lading and multimodal transport with the practice of multimodal transport.This paper analyzes the differences and similarities of documents, and analyzes the regulations of UCP500 on multimodal transport documents, as well as the frequently appeared documents in practice.According to the dispute, this paper also makes a detailed analysis, and puts forward its own views and relevant legislative suggestions.XiIt is hoped that the relevant issues mentioned in this article will improve the law of international multimodal transport and international multimodal transport.Practice, can be helpful.
