钻井平台污染损害赔偿法律问题研究

【摘要】：钻井平台日渐成为集复杂的技术、不菲的价格以及频繁的海上作业为一体的装置,它的商业和法律问题也变得日益突出,尤其是我国的一系列海上事故所反映出的平台作业安全和对环境的威胁更引人关注。本文从船舶和钻井平台的关系角度着手,对钻井平台污染损害赔偿法律问题行了初步研究,以期对我国立法与司法的完善敬一份建言。文章分四个部分展开论述：第一部分是对钻井平台的一般概述以及对钻井平台与船舶关系的阐释。钻井平台是一种可用于钻探的海上结构物,它是进行海洋勘探开发的重要手段,本部分讨论了钻井平台的物理特点和法律特点,而且从《海商法》对船舶界定的角度分析了钻井平台与船舶的关系,同时也从结构的角度以及用途的本质性角度分析了在涉及钻井平台污染损害赔偿法律问题时,是否能适用调整船舶的法律制度,这也是进行理论研究的问题和难点所在。第二部分阐述了我国钻井平台溢油事故处理现状及相关立法。这一部分分析了我国钻井平台溢油状况,随着经济的持续快速发展,我国对能源尤其是石油资源的需求量不断加大,海洋石油勘探开发量也在迅速地增长,同时,钻井平台对海洋所造成的污染也愈发严重。而目前调整钻井平台的海事国际公约主要是防污染的技术性公约,对钻井平台造成的污染损害赔偿问题进行规范的公约并不十分完善。本部分也讨论了钻井平台污染责任方面的法律现状并对此进行了评析。第三部分论述了完善钻井平台污染损害赔偿法律的必要性,本部分主要从钻井平台的污染后果、自身特点以及其促进海洋石油工业发展的角度对这一必要性进行了阐释。第四部分提出了完善我国钻井平台污染损害赔偿法律的对策建议。本部分在考虑我国现阶段的具体国情并借鉴国际社会对钻井平台污染损害赔偿法律问题的处理经验的基础上,提出了几点对策建议,旨在使钻井平台造成的污染损害赔偿起到很好的缓解和分散的作用。
[Abstract]:Drilling platforms are increasingly becoming devices that incorporate complex technologies, expensive prices and frequent offshore operations, and its commercial and legal problems are becoming increasingly prominent.In particular, a series of marine accidents in China reflect the safety of platform operation and the threat to the environment.From the point of view of the relationship between the ship and the drilling platform, this paper makes a preliminary study on the legal problem of the compensation for pollution damage caused by the drilling platform, in order to make a suggestion to the perfection of legislation and judicature in our country.The article is divided into four parts:The first part is the general overview of the drilling platform and the interpretation of the relationship between the rig and the ship.Drilling platform is a kind of offshore structure which can be used for drilling. It is an important means for marine exploration and development. The physical and legal characteristics of drilling platform are discussed in this part.At the same time, the relationship between drilling platform and ship is analyzed from the point of view of the definition of ship in Maritime Law. At the same time, from the point of view of structure and nature of use, the paper analyzes the legal problem of compensation for pollution damage caused by drilling platform.Whether the legal system of ship adjustment can be applied is also the problem and difficulty of theoretical research.The second part describes the status quo and relevant legislation of oil spill accident treatment of drilling platform in China.This part analyzes the oil spill situation of drilling platforms in China. With the sustained and rapid development of the economy, the demand for energy resources, especially oil resources, is constantly increasing in our country, and the amount of offshore oil exploration and development is also increasing rapidly, at the same time,The pollution caused by drilling platforms to the sea is becoming more and more serious.At present, the international maritime conventions regulating drilling platforms are mainly technical conventions on pollution prevention, and the conventions regulating the problem of compensation for pollution damage caused by drilling platforms are not very perfect.This part also discusses the status of drilling platform pollution liability and comments on it.The third part discusses the necessity of perfecting the pollution compensation law of drilling platform, which is mainly explained from the aspects of the pollution consequence of drilling platform, its own characteristics and its promotion to the development of offshore oil industry.The fourth part puts forward the countermeasures and suggestions to perfect the pollution compensation law of drilling platform in China.On the basis of considering the current situation of our country and drawing lessons from the experience of the international community in dealing with the legal problem of pollution compensation for drilling platforms, this part puts forward some countermeasures and suggestions.The purpose of this paper is to make the compensation for pollution damage caused by drilling platform play a good role in mitigating and dispersing.
