论港口经营人法律责任的若干问题

【摘要】:港口是各种运输方式之间的重要连接点,但至今没有建立完善的民事法律制度,虽然《港口货物作业规则》的颁布在一定程度上填补了这一空白,但其作为交通部的部门规章,层次较低。本文由港口经营人的含义、经营范围及法律地位,引出对其责任的归责原则、责任期间和责任限制的研究,独创性地提出由于港口经营人的业务活动是水路客货运承运人业务活动的延伸和补充,从法律体系角度而言,港口应纳入运输法律部门,因此港口经营人的责任期间的规定应当与水路客货承运人责任期间相匹配,与《海商法》及其他水运法规相衔接,以避免法律上的空白,即不能出现货物在港口发生灭失或损坏,或旅客发生人身伤亡或行李灭失损坏时,货方或旅客既不能向承运人也不能向港口主张权利的情况。同时,为了避免在发生货损或人身伤亡时出现法律真空,港口法规定的港口经营人的责任期间在某些情形下可能会与承运人的责任期间发生重叠,所以港口经营人的责任内容包括归责原则、责任限额及其丧失等就应尽可能避免与承运人的责任内容发生冲突,从而使客货方的权利义务在港口阶段具有一致性。
[Abstract]:The port is an important link between various modes of transport, but no perfect civil legal system has been established. Although the promulgation of the "Port cargo Operation rules" fills this gap to a certain extent, it is regarded as the department regulation of the Ministry of Communications. The level is lower. From the meaning, scope and legal status of the port operator, this paper introduces the principle of liability attribution, the period of liability and the limitation of liability. Creatively suggesting that, since the business activities of port operators are an extension and complement of the operational activities of waterway passenger and freight carriers, from the point of view of the legal system, ports should be incorporated into the transport legal sector, Therefore, the provisions of the period of responsibility of the port operator should be matched with the period of liability of the waterway passenger and cargo carrier, and should be linked to the Maritime Law and other waterborne regulations in order to avoid legal gaps, That is, there can be no loss or damage to the goods in the port, or personal injury or loss of baggage damage to the passengers, the cargo or passengers can neither claim rights from the carrier or the port. At the same time, in order to avoid a legal vacuum in the event of damage or personal injury, the period of responsibility of the port operator under port law may overlap in some cases with the period of responsibility of the carrier, Therefore, the content of the liability of the port operator includes the principle of imputation, the limitation of the liability and its loss, so as to avoid the conflict with the content of the carrier's liability as far as possible, so that the rights and obligations of the passenger and cargo parties are consistent in the port stage.
