【摘要】：随着国际海上运输的发展完善及国际旅游的快速发展，乘坐豪华邮轮环球旅行越来越受到人们的青睐。豪华邮轮旅游在旅游业内已经成为了一个重要且具有很大经济效益的旅游方式。但与此同时，在豪华邮轮旅游中一些潜在的法律问题也随之产生，邮轮承运人法律责任也成为邮轮旅游中的一个热点问题。我国此种旅游模式正在兴起和快速发展，相关法律规定也只是存在于我国《海商法》、《合同法》以及最高人民法院出台的有关规定中，比较缺乏系统性，有些方面也不完善。文章共分为五部分。第一部分，对邮轮旅游承运合同进行概述。首先，从邮轮旅游的定义、邮轮旅游的发展现状和邮轮旅游的特点进行相关介绍，将邮轮旅游与海上旅客运输进行对比指出邮轮旅游的特殊性，从而为研究邮轮承运人法律责任做铺垫；其次，主要从邮轮旅游承运合同的定义和合同的当事人、特殊性等方面分析；最后，介绍邮轮承运人的主要权利和义务。第二部分，分析邮轮承运人的责任期间。主要是从邮轮旅游承运人对旅客和行李的责任期间进行分别说明。第三部分，分析邮轮承运人的责任基础。此部分首先介绍国内对于邮轮承运人责任基础的规定，然后再论述《雅典公约》和其他国家对于此方面的规定，从国内和国际两方面进行比较，提出个人对于邮轮承运人责任基础的修改建议。第四部分，分析邮轮旅游承运人的赔偿责任。首先，说明国内有关承运人赔偿责任限制的规定，主要从国际旅客运输和沿海旅客运输两方面进行说明；其次，分析国际公约和其他国家有关承运人责任限制的规定；然后，对比邮轮此种海上交通方式和其他陆地或航空交通方式在承运人赔偿责任方面规定的不同；最后，在上述分析和对比中提出自己的相关建议。第五部分，指出在邮轮旅游中两种特定情形下承运人的责任。本文分析我国关于邮轮承运人法律责任的规定，并且与其他国家和国际公约相关法律规定进行对比研究，，在借鉴其先进经验的基础上，结合我国的实际情况，为我国在此方面法律制度的完善提出建议，为我国邮轮旅游中的司法实践提供理论指导。
[Abstract]:With the development of international maritime transportation and the rapid development of international tourism, travelling around the world by luxury cruise is becoming more and more popular. Luxury cruise tourism has become an important and economic tourism mode in the tourism industry. But at the same time, some potential legal problems arise in luxury cruise tourism, and the legal liability of cruise carriers has become a hot issue in cruise tourism. This kind of tourism mode is rising and developing rapidly in our country, and the relevant laws and regulations only exist in our country's Maritime Law, contract Law and the relevant regulations issued by the Supreme people's Court, which are lack of systematicness and some aspects are not perfect. The article is divided into five parts. The first part is an overview of the cruise contract. First of all, from the definition of cruise tourism, the development of cruise tourism and the characteristics of cruise tourism are introduced, the comparison between cruise tourism and maritime passenger transport points out the particularity of cruise tourism. Then it lays the groundwork for studying the legal liability of the cruise carrier. Secondly, it analyzes the definition of the cruise carrier contract and the parties and particularity of the contract. Finally, it introduces the main rights and obligations of the cruise carrier. The second part analyzes the period of liability of cruise carrier. Mainly from the cruise carrier's responsibility period for passengers and luggage are described separately. The third part analyzes the liability basis of cruise carrier. This part first introduces the domestic provisions on the basis of the liability of cruise carriers, and then discusses the Athens Convention and other countries on this aspect of the provisions, from the domestic and international aspects of comparison, Propose personal amendments to the basis of liability for cruise carriers. The fourth part analyzes the liability of cruise carrier. First, to explain the domestic provisions concerning the limitation of the carrier's liability, mainly from the aspects of international passenger transport and coastal passenger transport; secondly, to analyze the provisions of international conventions and other countries concerning the limitation of carrier's liability; then, Compare the differences between the sea traffic mode of cruise ship and other modes of land or air traffic in terms of carrier liability. Finally, in the above analysis and contrast, the author puts forward his own relevant suggestions. The fifth part points out the carrier's responsibility in two specific cases of cruise tourism. This paper analyzes the provisions on the legal liability of cruise carriers in China, and makes a comparative study with the relevant legal provisions of other countries and international conventions, on the basis of drawing lessons from its advanced experience and combining the actual situation of our country. It also provides theoretical guidance for the judicial practice of cruise tourism in China.
