船舶优先权若干法律问题的研究

【摘要】: 船舶优先权是海商法特有的一项法律制度,但是由于各国的基本法律制度存在差异,因此在船舶优先权的行使过程中亦存在着冲突。在我国,《海商法》颁布的时间较晚,因而关于船舶优先权的理论研究相对来说不够成熟,在实践中经常出现歧义,为司法上的统一带来若干困难。本文将结合国际法及我国的有关法律规定,,从司法实践中存在的一些问题出发,对船舶优先权制度的相关问题作一论述。 首先,本文对船舶优先权的产生、发展及现状作一论述,然后结合民商法中的物权法及担保法的有关规定,论证船舶优先权的性质是一种担保物权,在此基础上,总结出船舶优先权的特征;其次,对船舶优先权的内容作一论述。本章分三节,分别对船舶优先权的标的、项目和受偿顺序以及船舶优先权消灭的原因进行论述。在该章中,将结合国际公约、其他海运国家的相关法律规定以及部分案例,对我国船舶优先权的立法进行评述,并提出自己的见解。该部分是从理论上对船舶优先权进行探讨;第三,结合上述理论探讨,对船舶优先权行使过程中遇到的一些问题进行阐述。本章主要对司法实践中争议较多的船员工资优先权的主体、所有权变更下,船舶优先权的行使与诉讼的关系、船舶优先权的行使与扣船的关系以及船舶优先权的行使与海事赔偿责任限制的关系四个问题加以阐述。在该部分中,将结合不同的学术观点及有关案例进行分析,从而提出解决问题的思路。该部分是从实践上对船舶优先权的探讨;最后,总结全文,说明研究船舶优先权制度的重要意义。
[Abstract]:Maritime lien is a unique legal system of maritime law. However, because of the differences in the basic legal system of countries, there are conflicts in the exercise of maritime lien. In our country, the time of the promulgation of maritime law is relatively late. Therefore, the theoretical research on maritime lien is not mature enough and is often found in practice. The present ambiguity brings some difficulties to the unification of the judiciary. This article will discuss the problems related to the system of maritime lien in accordance with the international law and the relevant legal provisions of our country and from some of the problems that exist in the judicial practice.
First, this article discusses the production, development and present situation of the maritime lien. Then, combining the relevant provisions of the property law and the guarantee law in the civil and commercial law, it is demonstrated that the nature of the maritime lien is a kind of security right. On this basis, the characteristics of the maritime lien are summed up. Secondly, the contents of the maritime lien are discussed. This chapter is divided into three sections. In this chapter, the article reviews the legislation of China's maritime lien and puts forward its own opinions in this chapter, which is theoretically based on the theory of the ship. On the basis of the above theory, third, some problems encountered in the process of the exercise of maritime lien are discussed. This chapter mainly focuses on the main body of the wage priority of the crew in the judicial practice, the relationship between the exercise of the maritime liens and the litigation, the exercise of the priority of the ship and the buckle of the ship. The relationship between four problems and the relationship between the exercise of maritime lien and the limitation of maritime liability is expounded. In this part, it will be analyzed with different academic views and related cases, so as to put forward the idea of solving the problem. This part is a discussion of the Maritime Liens in practice; finally, the full text is summarized to explain the research ship. The importance of the ship's priority system.
