海上承运人的责任期间

【摘要】: 本文以海上承运人的责任期间为研究对象,通过比较国内审判实务、相关国际公约、正在起草的运输法草案等,分析我国《海商法》中责任期间制度所面临的问题,并提出解决方案。 遵循提出问题、分析问题、解决问题的思路,全文分为以下几个部分: 引言阐明论文的选题意义、当前研究现状、论文的目的以及研究路径与方法。 第一章介绍海上货物运输合同的类型,明确本文所讨论的货物运输类型为提单运输,介绍提单运输和责任期间的关系,并提出本文所要解决的问题。 第二章界定责任期间的概念。本章首先介绍国内所存在的争议,然后比较我国台湾地区学者的定义,以及《海牙规则》、《维斯比规则》、《汉堡规则》和运输法草案中的规定,得出《海商法》中的责任期间仅为强制责任期间;之后比较该强制责任期间、一般责任期间、法律适用期间、责任范围和合同期间等几个概念的差别和联系。 第三章主要分析责任和强制责任期间的关系。本章首先从历史的角度讨论责任和强制责任期间的发展变化,分析《海牙规则》、《维斯比规则》和《汉堡规则》里的不足,并对运输法草案里的规定进行评价。以此为基础,对我国《海商法》进行分析,指出强制责任期间内承运人的主给付义务为运输义务,而一般责任期间内承运人的主给付义务为运输和交付义务。 第四章则具体讨论责任期间和强制责任期间的存续期间。本章首先概要介绍强制责任期间存续期间的发展过程,然后具体分析实际承运人、多式联运经营人和无船承运人在我国《海商法》下的强制责任期间和一般责任期间。最后分析强制责任期间和一般责任期间开始和终结的标准。 第五章首先介绍其它货物运输方式的责任期间,然后讨论该责任期间和海上承运人的责任期间的衔接问题。本章共讨论五种运输方式,至于管道运输,虽然不属于合同法第17章所调整的货物运输方式,鉴于其在现实中应用的比较广泛,也在该章中一并讨论。 最后一部分为结语。首先对本文的观点进行总结和概括,然后提出修改建议。
[Abstract]:This paper takes the period of liability of the maritime carrier as the research object, analyzes the problems faced by the liability period system in Maritime Law of China by comparing domestic trial practice, relevant international conventions and the draft of the transport law that is being drafted. And put forward the solution. Following the ideas of problem raising, problem analysis and problem solving, the paper is divided into the following parts: The introduction clarifies the significance of the topic, the current research situation, the purpose of the paper, and the research path and method. The first chapter introduces the type of contract of carriage of goods by sea. It is clear that the type of transport of goods discussed in this paper is the transport of bill of lading. It introduces the relationship between bill of lading transportation and liability period, and puts forward the problems to be solved in this paper. The second chapter defines the concept of the period of responsibility. This chapter first introduces the domestic disputes, and then compares the definitions of scholars in Taiwan and the provisions of the Hague rules, Visby rules, Hamburg rules and the draft Transport Law. It is concluded that the period of liability in Maritime Law is only the period of compulsory liability, and then the differences and relations between the concepts of the period of compulsory liability, the period of general liability, the period of application of law, the scope of liability and the period of contract are compared. The third chapter mainly analyzes the relationship between the period of liability and compulsory liability. This chapter first discusses the development of liability and compulsory liability from a historical point of view, analyzes the shortcomings of the Hague rules, the Visby rules and the Hamburg rules, and evaluates the provisions of the draft Transport Law. Based on this analysis, the author points out that the carrier's main obligation during the period of compulsory liability is the obligation of carriage, while the obligation of carrier's main payment during the period of general liability is the obligation of carriage and delivery. The fourth chapter discusses the period of liability and the period of compulsory liability. This chapter firstly introduces the developing process of the period of compulsory liability, and then analyzes the period of compulsory liability and the period of general liability of actual carrier, multimodal transport operator and non-ship carrier under the Maritime Law of China. Finally, it analyzes the criteria for the beginning and end of compulsory liability period and general liability period. Chapter five first introduces the period of responsibility of other modes of carriage of goods, and then discusses the connection between the period of responsibility and that of the carrier at sea. This chapter discusses five modes of transport, as for pipeline transportation, although it is not part of the freight transport mode adjusted in Chapter 17 of the contract Law, it is also discussed in this chapter in view of its wide application in reality. The last part is the conclusion. First of all, summarize and summarize the views of this paper, and then put forward suggestions for modification.
