【摘要】：承运人航海过失免责制度的存废一直以来都是国际海商领域讨论的焦点,随着目前国际航运业的普遍发展,国际社会主张废除承运人航海过失免责制度的呼声日益高涨,如今已成为一种不可逆转的趋势。我国立法面对此趋势,是应该继续保留还是废除航海过失免责制度,成为众多学者研究的重点。本文从四个方面对此进行一一阐述:第一部分阐述了承运人航海过失免责制度的基本概念,并以时间为线索,将承运人航海过失免责制度的历史演变做一一介绍。第二部分探讨分析了国际上关于承运人航海过失免责制度存废理由的博弈,分别对废除和保留承运人航海过失免责制度存废的理由进行了一一阐述,并对此理由的合理性进行了一系列分析。第三部分对废除和保留承运人航海过失免责制度的影响分别作了探讨分析。首先阐述了废除承运人航海过失免责制度对承运人、货方、成本与运费以及其他相关海事制度的影响,其次阐述了保留承运人航海过失免责制度的影响。第四部分落脚点回归到我国,着力研究我国承运人航海过失免责制度。首先,介绍了我国承运人航海过失免责制度设立的历史背景;其次,对我国目前关于承运人航海过失免责制度存废的争论进行陈述;再次,对我国承运人航海过失免责制度存废的利弊均进行了一一探讨;最后,分析了我国对于承运人航海过失免责制度存废的态度及应对措施,一方面阐述了我国目前仍应继续保留承运人航海过失免责制度,另一方面分析了我国对目前承运人航海过失免责制度国际趋势的应对措施,并对我国海商法的完善及其他相关制度的建立与健全提供了一些自己的观点。
[Abstract]:The existence and abolition of the carrier's exemption from maritime fault has always been the focus of discussion in the field of international maritime business. With the general development of the international shipping industry, the voice of the international community advocating the abolition of the exemption system of the carrier's maritime fault has been rising day by day. Now it has become an irreversible trend. In the face of this trend, the legislation of our country should continue to retain or abolish the system of exemption from maritime negligence, which has become the focus of many scholars. This paper expatiates on this from four aspects: the first part expounds the basic concept of the carrier's maritime fault exemption system, and introduces the historical evolution of the carrier's maritime fault exemption system with time as the clue. The second part discusses and analyzes the international game of the reasons for the carrier's exemption from maritime negligence, and explains the reasons for abolishing and retaining the exemption system of the carrier's nautical fault. The rationality of this reason is analyzed. The third part discusses the influence of abolishing and retaining the exemption system of carrier's nautical fault. Firstly, the paper expounds the influence of abolishing the exemption system of the carrier's nautical fault on the carrier, the cargo party, the cost and the freight as well as other related maritime systems, and then expounds the influence of retaining the exemption system of the carrier's nautical fault. The fourth part goes back to our country and studies the exemption system of the carrier's nautical fault. First of all, it introduces the historical background of the establishment of the exemption system of the carrier's nautical fault; secondly, it states the debate on the existence and abolition of the exemption system of the carrier's nautical fault in our country; thirdly, This paper probes into the advantages and disadvantages of the exemption system of the carrier's nautical fault in China, and finally analyzes the attitude and countermeasures of our country to the exemption system of the carrier's nautical fault. On the one hand, this paper expounds that China should continue to retain the exemption system of carrier's nautical fault at present, on the other hand, analyzes the countermeasures of our country to the international trend of the current system of exemption from maritime fault of the carrier. It also provides some views on the perfection of China's maritime law and the establishment and perfection of other related systems.
