当代中国法律体系的反思与重构

【摘要】： 法律体系是一定区域的全部法律按照一定的逻辑结构所构成有机联系的整体。不同的社会经济、政治、文化状况,决定了不同的法律体系结构,并由此深刻影响着人们的相关认识和理解。当代中国法律体系是按法律的调整对象和调整方法划分为若干法律部门。主要由七个法律部门和三个不同层级的法律规范构成。七个法律部门是:宪法及宪法相关法,民商法,行政法,经济法,社会法,刑法,诉讼与非诉讼程序法。三个不同层级的法律规范是:法律,行政法规,地方性法规,自治条例和单行条例。但现行法律体系存在着误区和不足,其将宪法及宪法相关法作为与民商法等并列的法律部门,体现不出宪法的根本法地位,其不承认公法和私法的划分,使我国法律体系结构出现逻辑上的断层。通过对法律体系内涵和现代市场经济体制下法律结构构成要素的探讨,使人更深刻认识到重构我国法律体系事在必行,应突出宪法的“母法”地位,划分出公法、私法、和社会法三大法域,使在我国缺乏法律文化基础的私法,及缺失实施机制的社会法,能迅速发展和完善。建立起一个以宪法为统领金字塔式的层次分明、逻辑严谨、内容协调一致的社会主义法律体系结构。
[Abstract]:The legal system is an organic whole of all laws in a certain area according to certain logical structure. Different social, economic, political and cultural conditions determine different legal system structures, and thus profoundly affect people's understanding and understanding. The contemporary Chinese legal system is divided into several legal departments according to the object and method of legal adjustment. It is mainly composed of seven legal departments and three different levels of legal norms. Seven legal departments are: constitution and constitution-related law, civil and commercial law, administrative law, economic law, social law, criminal law, procedural and non-procedural law. Three different levels of legal norms are: laws, administrative regulations, local regulations, autonomous regulations and separate regulations. However, there are some misunderstandings and shortcomings in the current legal system. It regards the constitution and its related laws as the legal departments juxtaposed with the civil and commercial laws, which cannot reflect the status of the fundamental law of the constitution, and does not recognize the division between public law and private law. Make our country legal system structure appear logical fault. Through the discussion of the connotation of the legal system and the elements of the legal structure under the modern market economy system, it makes people realize that the reconstruction of the legal system in our country is inevitable, and should highlight the "mother law" status of the Constitution, and divide public law and private law into two parts: public law and private law. And the three major jurisdictions of social law make the private law which lacks the foundation of legal culture in our country and the social law that lacks the enforcement mechanism can develop and perfect rapidly. To establish a constitution-led pyramid-style, logical rigorous, coordinated content of the socialist legal system structure.
