海上危险品运输承托双方义务与责任研究

【摘要】:一直以来,海上危险货物运输作为海上运输领域的重要组成部分具有极大的特殊性,受到了航运界和海商法理论界的广泛关注。对于海上危险货物运输中承托双方义务与责任的问题更是近年来的研究热点。 本文从确定危险货物的定义入手,将研究的总体框架置于民事法律关系中,借鉴了相关的国际公约及其他国家的权威判例,重点对危险货物托运人的义务与责任、危险货物承运人的义务与责任问题进行了研究,并针对危险货物托运人向承运人履行法定告知义务、托运人违反告知义务应承担的责任等特殊问题进行了阐述。 具体来讲,本文分为四章,第一章通过对比国际公约和国内法对危险货物的定义的阐述,经过分析总结作者给出了本文对危险货物的具体定义;第二章列举了海上危险货物运输中有关承托双方义务与责任的相关立法,这为下文所进行的深入研究做好了铺垫;第三章具体深入地研究了海上危险货物运输中托运人的义务与责任承担问题,这也是本文的研究重点,作者关注了一些细节问题并提出了自己的建议;第四章分析了海上危险货物运输中承运人的义务与责任承担,对承运人所负义务方面提出了新的观点和建议。期望以上所做的分析研究能对促进海上危险货物运输业的发展及海事立法的完善有所裨益。
[Abstract]:As an important part of maritime transport, the transport of dangerous goods by sea has been paid great attention by the shipping and maritime law theorists. The research on the obligations and responsibilities of both parties in the transport of dangerous goods by sea has been a hot topic in recent years. This paper begins with the definition of dangerous goods, puts the general framework of the study in the civil legal relationship, draws lessons from relevant international conventions and authoritative jurisprudence of other countries, and focuses on the obligations and liabilities of the shippers of dangerous goods. This paper studies the obligation and liability of the carrier of dangerous goods, and expounds the special problems such as the discharge of the legal obligation of notification to the carrier by the shipper of dangerous goods and the liability of the shipper for breach of the obligation of notification. Specifically, this paper is divided into four chapters. The first chapter compares the definition of dangerous goods between international conventions and domestic law, and gives the specific definition of dangerous goods by analyzing and summarizing. The second chapter lists the relevant legislation about the obligations and responsibilities of both parties in the carriage of dangerous goods by sea, which paves the way for the further study below. The third chapter studies the shipper's obligation and responsibility in the transport of dangerous goods by sea, which is also the focus of this paper. The author pays attention to some details and puts forward his own suggestions. The fourth chapter analyzes the carrier's obligations and responsibilities in the carriage of dangerous goods by sea, and puts forward some new viewpoints and suggestions on the carrier's obligations. It is expected that the above analysis and research will be beneficial to the development of the maritime dangerous goods transportation industry and the improvement of maritime legislation.
