商人权利保护机制之变迁:理论反思和体系再造

【摘要】：商人的权利保护是商法的核心内容。商人权利保护机制在不同历史阶段具有不同的表现形式,始终在根据商法体系调整而不断发展完善。法典化时代之前的商法本质上属于商人的特权法。法典化时代商人的权利已经成文化,但是商法的调整重心已经变为商行为。宪法化时代商人权利的保护需要从基本权利保护的角度加以反思。全球化时代商人权利的保护又面临新挑战。我国商法体系建构需要商人权利保护围绕这一核心内容加以展开。
[Abstract]:The protection of merchant's rights is the core content of commercial law. The protection mechanism of merchant's rights has different forms of expression in different historical stages, and has been constantly developed and perfected according to the adjustment of commercial law system. The commercial law before the age of codification is essentially the privileged law of the merchant. In the age of codification, the rights of merchants have become culture, but the center of adjustment of commercial law has been changed into commercial firms. The protection of businessman's rights in the constitutional era needs to be reconsidered from the angle of the protection of basic rights. In the era of globalization, the protection of businessman's rights is facing new challenges. The construction of commercial law system needs the protection of merchant's rights around this core content.
