关于担保物权立法体例问题的争议与思考

【摘要】：在我国《民法典》制定过程中,学术界对担保物权立法体例问题存在着较大争议。笔者认为,在立法体例问题上,应采民商合一制来规定担保物权制度,即应将普通担保物权整合规定于《民法典》中,而把经济生活中出现的新的和特殊的担保形式,以民事特别法的方式作出规定。这既符合当代民商法相互融合的发展趋势,又符合我国的立法传统。
[Abstract]:In the process of making the Civil Code of our country, there is a great controversy on the legislative style of security property right in academic circles. In my opinion, in the legislative style, we should adopt the system of the integration of the civil and commercial people to stipulate the system of security interest, that is, we should integrate the common security interest into the Civil Code, and put the new and special forms of security in the economic life. To make provisions in the form of a civil Lex specialis. This not only accords with the development trend of the contemporary civil and commercial law, but also accords with the legislative tradition of our country.
