网上银行相关法律问题探究

【摘要】：网上银行给人类的生活带来了深刻的影响，，对传统的法制和理念提出了挑战。网上银行所涉及的法律问题甚为丰富而复杂，这源于该业务所具有的高科技性、无纸化、瞬时性等特点。本文结合国内外相关立法以及国内银行开展网上银行业务的实践，对网上银行所涉及的法律问题作了初步的探讨和分析。文章主要涉及了网上银行市场准入、网上银行监管、网上银行业务中的法律关系、法律问题、网上银行引起的法律变革以及网上银行立法六个方面的法律问题。本文共分五个部分：第一部分首先对网上银行的定义作了界定，归纳出了网上银行的基本特征及其优势，并对网上银行的种类和发展现状作了简单介绍，以便人们对网上银行形成概括的认识。第二部分介绍了网上银行的市场准入和监管法律制度。首先介绍了我国的网上银行市场准入制度。然后从比较法的角度介绍了美国和欧洲网上银行的监管模式，在借鉴国外先进的监管经验并结合我国实际的基础上，分析了我国网上银行监管的难点、监管的内容和措施。第三部分阐述了网上银行业务中的法律问题。首先从总体上归纳了网上银行业务中的法律关系，然后在此基础上开始对网上银行业务中的具体法律问题加以分析。这些具体法律问题包括：签字与认证的法律问题、交易证据的法律问题、事故、故障造成损失时当事人的法律责任、网上银行业务中的刑事犯罪问题和跨国网上银行业务中的法律适用与管辖权问题。第四部分从经济法、民商法、刑法、民事诉讼法和国际私法中准据法的选择五个方面剖析了网上银行所引起的现行法律的变革。第五部分通过对网上银行相关法律问题的概括和总结，从宏观角度提出了网上银行的立法建议。
[Abstract]:Internet banking has brought profound influence to human life and challenged the traditional legal system and concept. The legal problems involved in online banking are very rich and complex, which is due to the characteristics of high-tech, paperless, instantaneous and so on. Based on the domestic and foreign relevant legislation and the practice of domestic banks carrying out online banking, this paper makes a preliminary discussion and analysis on the legal issues involved in online banking. This paper mainly deals with the legal relationship, legal problems, the legal reform caused by internet banking and the legislation of internet banking in the following six aspects: market access for internet banking, supervision of internet banking, legal relationship in internet banking business. This paper is divided into five parts: the first part defines the definition of online banking, summarizes the basic characteristics and advantages of Internet banking, and briefly introduces the types and development status of online banking. So that people form a general understanding of online banking. The second part introduces the legal system of market access and supervision of internet banking. First of all, it introduces the market access system of internet bank in our country. Then it introduces the supervision mode of American and European online banking from the perspective of comparative law, and analyzes the difficulties, contents and measures of Chinese online banking supervision on the basis of drawing lessons from foreign advanced supervision experience and combining with our country's actual situation. The third part expounds the legal problems in the online banking business. In this paper, the legal relationship in the online banking business is summarized, and then the specific legal problems in the online banking business are analyzed. These specific legal issues include: legal issues of signature and certification, legal issues of transaction evidence, legal liability of the parties in the event of an accident or failure, Criminal offences in internet banking and legal application and jurisdiction in transnational internet banking. The fourth part analyzes the current legal changes caused by online banking from five aspects: economic law, civil and commercial law, criminal law, civil procedure law and the choice of applicable law in private international law. The fifth part, through the summary and summary of the related legal problems of the internet bank, puts forward the legislative suggestions of the internet bank from the macro point of view.
