国际私法名称初探

【摘要】： 国际私法的名称问题是国际私法学中的一个基本的问题。在解决此问题上要同时注意本土视角和世界视角的研究方法的运用。国际私法范围是决定国际私法名称的内在的决定性因素。其本体范围应当只包括冲突规范，即法律适用规范或法律选择规范。国际私法也就是决定于何种情形下适用何国法律及如何适用之具体法则。其它的相关的规范分属独立的国际民事诉讼法、国际商法、国际商事仲裁法等，而非国际私法。在我国，传统的占主导地位的“国际私法”称谓不符合国际私法的要求，体现在：第一、“国际”一词不能使该称谓包容区际私法。第二、“私法”一词不能反映国际私法的本质属性，，且公、私法划分方法本身也远非理想。其它的常见的“法则区别说”、“法律冲突法”、“涉外私法”、“法律适用法”等也存在问题，未能提供完全的答案。“域际法律适用法”或“域际法律选择法”的提法可认为是其合适的称谓。“域际”既可指狭义之“地域”，也可以指广义之“地域”、“时域”、“人域”。另外，“域际”还可指区际和国际。所以，“域际法律适用法”、“域际法律选择法”可以同时指代除属地性国际冲突法之外的属地性区际法律冲突法、属人性的人际法律冲突法、属时性的时际法律冲突法等。并且，是符合“一国两制”等中国特殊国情的。“法律适用法”部分提法可放弃不合理的公、私法划分标准；反映了国际私法的性质和精神实质；符合术语单义性要求。总体上的“域际法律适用法”的提法可将公法冲突纳入国际私法调整范畴；符合法律术语的“视窗”性要求；有利于本身及相关部门法和部门法学的形成和发展；符合中华民族的相关历史、文化传统和现实国情。
[Abstract]:The title of private international law is a basic problem in private international law. In solving this problem, we should pay attention to the application of both local and world perspective. The scope of private international law is an inherent decisive factor in determining the name of private international law. Its Noumenon scope should only include conflict norm, namely law application norm or law choice norm. Private international law is the specific law that determines under which circumstances the law of which country is applied and how to apply it. Other related norms are independent international civil procedure law, international commercial arbitration law and so on, not private international law. In our country, the traditional title of "private international law" does not conform to the requirements of private international law. Firstly, the term "international" cannot make the term "international" include private international law. Second, the term "private law" cannot reflect the essential attribute of private international law, and the method of dividing private law itself is far from ideal. Other common "law distinction", "conflict of laws", "private law concerning foreign affairs", "law application law" and so on also have problems, which fail to provide a complete answer. The formulation of the Interterritorial Law Application Law or the Interterritorial Law Choice Law can be regarded as a suitable term. "Interdomain" can not only refer to the narrow sense of "region", but also to the broad sense of "region", "time domain", "human domain". In addition, "Interregional" can also refer to interregional and international. Therefore, "Interterritorial Law Application Law" and "Interregional Law Choice Law" can simultaneously refer to the territorial inter-regional conflict law other than the territorial international conflict law, the interpersonal conflict law of human nature, the temporal law of inter-temporal conflict of law, and the law of inter-regional conflict of law, which belongs to human nature, and the law of intertemporal conflict of law, and so on. Moreover, it is in line with China's special national conditions such as "one country, two systems". Part of the formulation of the Law on the Application of Law may give up unreasonable criteria for the division of public and private law, reflecting the nature and spiritual essence of private international law and meeting the requirements of the simplistic nature of the term. On the whole, the formulation of "Interterritorial Law Application Law" can bring the conflict of public law into the scope of adjustment of private international law, accord with the requirement of "window" of legal terminology, be beneficial to the formation and development of its own and related sectoral law and departmental law. In line with the relevant history of the Chinese nation, cultural traditions and the reality of the national conditions.
