论我国海运履约方制度的构建

【摘要】:联合国贸易法委员会从1996年开始致力于统一海上货物运输法律制度的新尝试,经过多年的磋商讨论,2008年7月3日通过了《全称或部分海上货物运输合同公约》。并于2009年9月23日在鹿特丹举行了签字仪式。公约内容庞杂,其使用范围和调整事项均超出海牙规则、维斯比规则、汉堡规则三个现行有效的海运公约。海运履约方制度是公约中颇具特色的制度,它构成了公约责任制度的有机组成部分,是公约起草过程中重点讨论的内容之一。海域履约方制度虽然不是第一次将承运人的履约辅助人纳入调整,但却是最全面、最彻底的一次。它统一了海运段的承运人履约辅助的责任,是国际海运法律体制统一化进程中的又一次进步,意义深远。 本文运用历史分析、比较分析、理论分析的方法对海运履约方制度的沿革、制度构成、制度价值和我国相关制度构建等方面进行了系统深入的讨论。本文共分三章。第一章对海运履约方制度进行概述,介绍了海运履约方制度的内容和特征。第二章首先介绍了我国相关制度和海运履约方制度的差异,进而分析了我国目前相关法律存在的问题,最后阐述了构建我国海运履约方制度存在的困难。在前两章阐述、分析的基础之上,第三章,重点就建立我国海运履约方制度提出几种策略,并分析在建立我国海运履约方制度过程中需要解决的问题以及需要注意的事项。 本文最后提出作者观点,即:通过不加入公约但在我国《海商法》中引入海运履约方制度的途径,来建立我国的海运履约方制度。
[Abstract]:The United Nations Commission on Trade Law (UNCITRAL) has been working on a new attempt to harmonize the legal regime for the carriage of goods by sea since 1996. After years of consultation and discussion, the Convention on contracts for the Carriage of goods by Sea (full or partial) was adopted on 3 July 2008. The signing ceremony was held in Rotterdam on September 23, 2009. Its scope of use and adjustment goes beyond the Hague rules, the Visby rules, and the Hamburg rules, which are currently in force for maritime transport. The maritime performing party system is a special system in the convention, which constitutes an organic part of the liability system of the convention and is one of the key contents discussed in the drafting process of the convention. Although the maritime performing party system is not the first time to adjust the carrier's performance assistant, it is the most comprehensive and thorough one. It unifies the carrier's responsibility for supporting the performance of the maritime transportation section, and it is another step forward in the process of the unification of the international maritime legal system, with far-reaching significance. By using the methods of historical analysis, comparative analysis and theoretical analysis, this paper makes a systematic and in-depth discussion on the evolution, constitution, value of the system and the construction of the relevant system in China. This paper is divided into three chapters. The first chapter summarizes the maritime performing party system, introduces the content and characteristics of the maritime performing party system. The second chapter first introduces the differences between our country's relevant system and maritime performing party system, and then analyzes the problems existing in our country's current relevant laws, and finally expounds the difficulties in constructing the maritime performing party system in our country. On the basis of the first two chapters, the third chapter puts forward some strategies on the establishment of the maritime performing party system in our country, and analyzes the problems that need to be solved and the matters needing attention in the process of establishing the maritime performing party system in our country. Finally, this paper puts forward the author's view that the maritime performing party system should be established by introducing the maritime performing party system into China's Maritime Code by not acceding to the convention and introducing the maritime performing party system into China's Maritime Code.
