港口经营人责任限制法律问题研究

【摘要】:由于《港口法》仅调整港口行政法律关系,《海商法》和其他调整民事主体的法律都没有专门对港口经营人民事法律关系做出规定,在司法实践中出现货主因货损起诉港口经营人要求赔偿的诸多纠纷,其核心争议点大部分集中于港口经营人是否有权限制赔偿责任。学者们也对港口经营人法律地位及是否有权限制赔偿责任发表见解。本文拟将港口经营人置于海上货物运输法律关系中,在清晰界定港口经营人法律地位的基础上,通过对国际公约和国内法的研究浅析港口经营人责任限制问题的国际立法趋势,探讨我国明确港口经营人责任限制的合理性,进而探索我国港口经营人责任限制的最佳解决途径。 全文分为引言、正文和结语三大部分,其中正文又分六部分: 第一部分主要介绍港口经营人的定义和赔偿责任限制定义及分类 第二部分主要介绍了港口经营人法律地位的几种学说,目的是明确港口经营人的法律地位,为下文探讨在相关立法中法律地位确立和享有责任限制权利做铺垫。 第三部分主要讨论在国际公约和国内法中港口经营人法律地位的界定和对港口经营人享有单位责任限制权利的分析。 第四部分主要讨论在相关立法中港口经营人法律地位的界定和港口经营人能否享有综合责任限制权利(海事赔偿责任限制)。 第五部分主要分析我国明确港口经营人责任限制的必要性。 第六部分主要寻求我国港口经营人责任限制问题的最佳解决之道;通过探讨明确港口经营人责任限制各种可能途径的可行性,认为在《海商法》中单独规定与承运人责任限制相一致的港口经营人责任限制权利,是解决我国港口经营人责任限制问题最合理、最有效的途径。
[Abstract]:Since the Port Law only regulates the administrative and legal relations of ports, neither the Maritime Law nor other laws regulating civil subjects specifically regulate the legal relationship between the people in port operations, In judicial practice, there are many disputes in which shippers sue port operators for damages. Most of the disputes are focused on whether the port operators have the right to limit the liability for compensation. Scholars have also expressed their views on the legal status of port operators and whether they have the right to limit liability. Based on the clear definition of the legal status of the port operator, this paper intends to put the port operator in the legal relationship of the carriage of goods by sea, and analyzes the trend of international legislation on the limitation of the liability of the port operator through the study of international conventions and domestic laws. This paper discusses the rationality of the limitation of the port operator's liability in our country, and then probes into the best way to solve the limitation of the port operator's liability in our country. The full text is divided into three parts: introduction, text and conclusion. The main body is divided into six parts: the first part mainly introduces the definition of the port operator and the definition and classification of liability limitation. The second part mainly introduces several theories of the legal status of the port operator. The purpose of this paper is to clarify the legal status of the port operator and to lay the groundwork for the establishment and enjoyment of the right of limitation of liability in the relevant legislation. The third part mainly discusses the definition of the legal status of port operators in international conventions and domestic laws and the analysis of the rights of port operators to enjoy the limitation of unit liability. The fourth part mainly discusses the definition of the legal status of the port operator in the relevant legislation and whether the port operator can enjoy the right of comprehensive liability limitation (limitation of maritime compensation liability). The fifth part mainly analyzes the necessity of defining the limitation of port operator's liability in our country. The sixth part mainly seeks the best way to solve the problem of the limitation of the port operator's liability in our country; By exploring the feasibility of clarifying the various possible ways to limit the liability of the port operator, it is considered that the limitation right of the liability of the port operator, which is consistent with the limitation of the carrier's liability, is separately stipulated in the Maritime Code, It is the most reasonable and effective way to solve the limitation problem of port operator's liability in our country.
