房地产产权保险法律制度研究

【摘要】: 房地产产权保险是美国等国家广泛适用的用于保障交易安全的一个重要保险品种,产权报告是该制度的关键。房地产产权保险一般由保险公司专员在调查房地产权状况后编纂而成,保险公司承诺如果房地产产权存在产权报告中应记载而没有记载的瑕疵和纠纷,保险人负责消除产权瑕疵,或在保险金额范围内对被保险人的损失进行赔偿。这一保险制度对减免房地产产权登记机关的负担、提升交易安全和效率、促进保险业的发展均有重要意义,值得我国借鉴和选择性移植。但我国与美国的登记制度等存在差异,制度的引进和重新构建需考虑诸多条件因素。 本文分为五个部分。 第一部分介绍房地产产权保险的内涵。该部分对产权、房地产产权做出了明确界定,阐明了房地产产权保险的对象。通过与普通人寿险和财产险的比较,凸出房地产产权保险在保险标的、范围、期间、保险费、保险责任等方面的特殊性。之后简述了房地产产权保险的运作方式。 第二部分从理论上对房地产产权保险进行了分析。首先是从经济学角度分析,表明保险在化解风险方面的价值,随后从民商法、经济法、社会法的角度,分析房地产产权保险的法律性质,阐明其对促进民法上的交易便捷、社会法追求的社会整体福利,并论述了以经济法对房地产产权保险进行规制的理论基础。 第三部分介绍了产权保险在美国产生的背景和原因,以期找到与当今中国环境的共同点。之后分析了美国产权保险制度对于中国的价值,得出需因地制宜构建中国的房地产产权保险的结论。 第四部分分析了我国房地产交易中存在的多方面风险以及房地产保险业的现状与不足,着重分析现有房产交易中公证程序、律师见证程序对保障交易安全的不足。此外,该部分分析了我国登记程序存在的不足,房地产产权保险可以成为登记制度改革的保障措施。之后,该部分点出了房地产产权保险制度在我国面临的障碍。 第五部分试图构建我国的房地产产权保险制度。首先从立法角度,提出了立法模式的选择,提出制定《房地产产权保险试行条例》的构想,构建了条例的指导原则、房地产产权保险的品种,阐明了房地产产权保险的基本构成要素,以及对房地产产权保险的监管建议。之后提出了房地产产权保险的相关配套措施,主要从登记性质的转换、产权信息库的构建作出说明。最后提出了房地产产权保险在现阶段试推行的折中方案。 本文综合运用了比较法学、经济学、社会学等研究方法,对房地产产权保险制度进行了研究,该选题价值在于通过构建我国的房地产产权保险制度,重新界定房地产产权登记机关权责,以期达到改变现有登记制度或弥补其不足,以及促进房地产交易安全的效果。
[Abstract]:Real estate property right insurance is an important insurance variety widely used to ensure transaction security in the United States and other countries, and property right report is the key to the system. The real estate property right insurance is generally compiled by the commissioner of the insurance company after investigating the property right of the real estate. The insurance company promises that if the real estate property right has defects and disputes that should be recorded in the property right report but not recorded in the property right report, The insurer is responsible for eliminating the defects of property rights or compensation for the losses of the insured within the insured amount. This insurance system is of great significance to reduce the burden of real estate property rights registration authorities, improve transaction security and efficiency, and promote the development of insurance industry, which is worthy of reference and selective transplantation in our country. However, there are differences in the registration system between China and the United States, and the introduction and reconstruction of the system need to consider many conditional factors. This paper is divided into five parts. The first part introduces the connotation of real estate property right insurance. This part makes a clear definition of property rights and real estate property rights, and clarifies the object of real estate property rights insurance. By comparing with ordinary people's life insurance and property insurance, this paper highlights the particularity of real estate property right insurance in the aspects of subject matter, scope, period, insurance premium, insurance liability and so on. Then it briefly describes the operation mode of real estate property right insurance. The second part theoretically analyzes the real estate property right insurance. First of all, from the economic point of view, it shows the value of insurance in resolving risks, and then from the perspective of civil and commercial law, economic law, social law, analyzes the legal nature of real estate property rights insurance, and clarifies its convenience in promoting the transaction in civil law. The social welfare pursued by social law, and discusses the theoretical basis of regulating real estate property right insurance by economic law. The third part introduces the background and reasons of property right insurance in the United States, in order to find the common ground with today's Chinese environment. Then it analyzes the value of the American property right insurance system to China, and draws the conclusion that it is necessary to construct the real estate property right insurance in China according to the local conditions. The fourth part analyzes the risks existing in the real estate transaction in our country and the present situation and shortcomings of the real estate insurance industry, focusing on the lack of notarization procedure and lawyer witness procedure in the existing real estate transaction to ensure the security of the transaction. In addition, this part analyzes the shortcomings of the registration procedure in our country, and the real estate property right insurance can become the safeguard measure of the registration system reform. After that, this part points out the obstacles faced by the real estate property right insurance system in our country. The fifth part tries to construct the real estate property right insurance system of our country. First of all, from the legislative point of view, this paper puts forward the choice of legislative mode, puts forward the idea of formulating the trial regulations of Real Estate property Rights Insurance, and constructs the guiding principles of the regulations and the varieties of real estate property rights insurance. This paper expounds the basic elements of real estate property right insurance and the supervision suggestions of real estate property right insurance. Then it puts forward the relevant supporting measures of real estate property right insurance, mainly from the transformation of registration nature and the construction of property right information base. Finally, the paper puts forward the compromise scheme of real estate property right insurance at this stage. This paper makes a comprehensive use of comparative law, economics, sociology and other research methods to study the real estate property right insurance system. The value of this topic lies in the construction of the real estate property right insurance system in our country. In order to change the existing registration system or make up for its shortcomings, and to promote the safety of real estate transactions, the power and responsibility of real estate property rights registration authority can be redefined in order to achieve the effect of changing the existing registration system or making up for its shortcomings.
