行政诉讼立案登记制运行研究

【摘要】:党的十八届四中全会明确提出:人民法院的案件受理制度,由立案审查制改为立案登记制,人民法院受理案件做到有案必立,有诉必理。最高人民法院根据中共中央关于“改革法院案件受理制度,变立案审查制为立案登记制”的要求,于2015年4月15日发布《关于人民法院推行立案登记制改革的意见》,改变人民法院立案受理制度,由立案审查制度改变成立案登记制。立案登记制对保护当事人的诉权,进一步提升人权保障制度化和法治化的水平有深远意义。行政诉讼案件历来是社会关注的热点,立案问题是行政诉讼的“老大难”,被外界诟病已久,故立案制度改革消息一出,倍受社会关注。从行政诉讼法实施的第一天,各大主流媒体争相对行政案件立案相关数据的报导可见一斑。立案登记制在行政诉讼领域的实施,一定程度上解决了行政诉讼一直为外界诟病的立案难的问题,但由于行政诉讼实施立案登记制的时机并不成熟,同时立案登记制度本身存在一些缺陷,以及在司法体制改革的大背景下,人民法院对改革立案制度的准备尚不充分,导致立案登记制在司法实践运行时产生了一些新情况、新问题。这些问题如不解决,一方面容易使立案登记制流于形式,不能起到真正实现立案登记切实保障当事人诉讼权利的作用,另一方面,对人民法院审判工作的正常运转造成不利影响。因此,对行政诉讼案件立案登记制度进行研究与完善,使制度中的基本诉讼理念及值观成为社会共识,正确引导人民群众行使诉讼权力,使立案登记制度发挥其应有作用,具有现实意义。学界一直从行政诉讼诉权保障角度探讨我国是否适合实施立案登记制以及立案登记制在解决立案难的问题上的迫切需要,很少从司法实践角度探讨立案登记制对现行司法现状带来的冲击以及在司法实践中的运行情况。英国、美国、德国等西方国家与我国国情有所区别,故对立案制度的配套制度不能生搬硬套,要深入研究我国立案登记制所要保护的价值的基础上,向域外立案制度借鉴符合我国基本国情的相关配套制度。本文从立案工作的发展进程、主要内容入手,通过分析我国当前司法改革初期以及行政诉讼当前情况,探讨顺利实施立案登记制的背景制约因素。利用数据及实例说明立案登记制在具体实施过程中产生的问题,分析产生的原因以及不解决的严重后果,通过对比我国立案登记制与域外立案制度的区别,论证构建行政立案登记制度的配套制度的可行性。在此基础上,以笔者司法实践中所总结的经验对立案登记制当前运行过程中产生的问题提出解决的对策。
[Abstract]:The fourth Plenary session of the 18 CPC Central Committee explicitly proposed that the system of accepting cases in the people's courts should be changed from the filing and examination system to the registration system. The Supreme people's Court is in accordance with the request of the CPC Central Committee on "reforming the system of accepting court cases and changing the system of filing and examining cases into a system of filing and registering." In April 15th 2015, the opinions on the reform of the people's court's filing registration system were issued, which changed the people's court's filing and accepting system. The system of filing and examination should be changed into the system of filing registration, which will protect the litigant's right of action. It is of far-reaching significance to further enhance the level of institutionalization and legalization of human rights protection. Administrative litigation cases have always been a hot spot of social concern, and the issue of filing a case is the "old difficulty" of administrative litigation, which has been criticized by the outside world for a long time. Therefore, the news of the reform of the filing system has attracted much attention from the first day of the implementation of the Administrative procedure Law. The major mainstream media scramble for the administrative case filing related data reports can be seen. The implementation of the registration system in the field of administrative litigation, to some extent, has solved the administrative litigation has been criticized by the outside world difficult to file the problem. However, due to the administrative proceedings to implement the registration system is not mature, at the same time there are some defects in the registration system itself, and in the context of the reform of the judicial system. The people's court is not fully prepared to reform the filing system, which leads to some new situations and new problems in the judicial practice, if these problems are not solved. On the one hand, it is easy to make the registration system become a mere formality, which can not play a real role in ensuring the litigants' litigation rights, on the other hand. It has a negative impact on the normal operation of the people's court. Therefore, the research and improvement of the registration system of administrative litigation cases make the basic litigation concept and the value of the system become a social consensus. We should correctly guide the masses to exercise their litigation rights and make the registration system of filing cases play its due role. The academic circles have been discussing whether it is suitable to implement the registration system and the urgent need of the registration system in solving the problem of filing the case from the angle of safeguarding the administrative litigation right. Rarely from the point of view of judicial practice, the impact of the registration system on the current judicial situation and its operation in judicial practice. The United Kingdom, the United States, Germany and other Western countries and China's national conditions are different. Therefore, the supporting system of the filing system can not be mechanically applied, we should deeply study the value of the registration system in our country. This paper starts with the development process and main content of the filing work, through the analysis of the current judicial reform in our country and the current situation of administrative litigation. This paper discusses the background constraints of the successful implementation of the registration system. It uses data and examples to illustrate the problems arising from the implementation of the registration system, analyzes the causes and the serious consequences that are not resolved. By comparing the difference between the registration system of our country and the system of overseas filing, this paper demonstrates the feasibility of constructing the matching system of administrative registration system. Based on the experience summarized in the author's judicial practice, the countermeasures are put forward to solve the problems arising in the current operation of the registration system.
