既判力与第三人撤销之诉制度之完善

【摘要】：在民事诉讼法体系中，既判力理论处于重要的地位，它和第三人撤销之诉制度紧密联系，第三人撤销之诉一方面以既判力理论为立论基础，另一方面又在很大程度上对既判力造成否定，动摇司法判决的效力，而在否定的同时，也在一定程度上也支持了既判力理论的主体扩张—-为第三人提供事后救济，弥补其事前程序的缺失。随着我国新民诉法的修改，第三人撤销之诉制度的设立，必然会带来新的诉讼类型的适用，因此，有必要对相关理论制度进行梳理，以求深入认识我国第三人撤销之诉制度。本文除引言和结语外，共分三章，第一部分对既判力理论和第三人撤销之诉作综合论述，以求明晰各自内涵，，同时对两者的关系作了简单的剖析。第二部分是第三人撤销之诉的比较法分析，第三人撤销之诉源于法国、台湾地区，对我国制度的理解和适用离不开比较法上的考察。第三部分是本文论述的重点，通过对既判力主观范围扩张的分析以及与第三人相关制度之比较，综合论述了我国第三人撤销之诉制度的内涵。
[Abstract]:In the civil procedure law system, res judicata theory is in an important position, which is closely related to the system of the third party's revocation. On the one hand, the third party's revocation action is based on the theory of res judicata. On the other hand, to a large extent, it negates the res judicata and shakes the validity of the judicial decision, while negating it. To some extent, it also supports the expansion of the subject of res judicata theory-to provide the third party with ex post relief, to make up for the lack of prior procedure. With the revision of the new civil action law, the third party revoked the establishment of the system. Therefore, it is necessary to comb the relevant theoretical system in order to deeply understand the system of third party revocation in our country. In addition to the introduction and conclusion, this article is divided into three chapters, the first part of the res judicata theory and the third party revocation of the action for a comprehensive discussion, in order to clarify their connotations. At the same time, the relationship between the two is simply analyzed. The second part is the comparative law analysis of the third party's revocation action, the third party's revocation action originates from France, Taiwan area. The third part is the focus of this paper, through the analysis of the expansion of the subjective scope of res judicata and the comparison with the third party system. This paper comprehensively discusses the connotation of the system of third party revocation in our country.
