论我国农村基层纠纷的行政调解

【摘要】：调解这一概念起源于中国古代法律治理的方针政策中。中国自古以来崇尚以仁治国,以理服人,以和为贵,早在西周时期,在地方官吏中就有“调人”之职,其职能为“司万民之难而谐合之”。自此,调解制度一直普遍存在,但是直到元代时,才将“调解入律”,后经过明清两代,又日趋完善。近几十年来,随着新中国的建立,我国法制建设也不断完善,行政法的发展经历了一个从不完备到相对完备的状态。但是行政法的立法及其理论发展仍然有所欠缺。① 本文题目为论我国农村基层纠纷的行政调解。文章共分成四个部分。第一部分是关于行政调解制度的理论分析,首先是关于行政调解制度的概述,阐明行政调解的含义并从概念的理论分析和具体问题进行阐述。其次分析了行政调解的特点包括其制度上的特殊之处,救济上和效力上的性质。文章的第二部分阐述了我国的行政调解制度在解决农村基层纠纷中的重大意义和作用,分别从促进社会的和谐；促进政府职能转变、塑造服务性政府的意义和具体的五方面作用阐述了其制度的闪光点以及适用该制度的必要性。文章的第三部分笔者运用手中所掌握的第一手资料,总结了目前行政调解制度在农村基层调解中的现状,并由此分析其存在的各种问题,试图在后文中能够对症下药,切实地提出解决办法。文章的第四部分是全文的重点部分,主要是针对我国农村基层行政调解所表现出来的弊端和不足之处,提出有价值的解决办法。包括立法与规范需要统一,健全行政调解机构,完善程序,明确范围等等。面对我国农村纠纷行政解决机制的缺陷与不足,我们不能因此否定整个制度,而是应当从制度完善的角度去探讨如何弥补不足,完善整个机制,以充分发挥其优势,实现其功能和价值。
[Abstract]:The concept of mediation originated in the principles and policies of legal administration in ancient China. Since ancient times, China has advocated governing the country with benevolence, persuading others with reason and taking harmony as the most precious. As early as the Western Zhou Dynasty, local officials had the duty of "mediating people". Since then, the mediation system has been widespread, but it was not until the Yuan Dynasty that the mediation was brought into the law. After two generations in the Ming and Qing dynasties, it became more and more perfect. In recent decades, with the establishment of New China, The development of administrative law has gone through a state of incomplete to relatively complete. However, the legislation of administrative law and its theoretical development are still lacking. The article is divided into four parts. The first part is the theoretical analysis of the administrative mediation system, first of all, the summary of the administrative mediation system. This paper clarifies the meaning of administrative mediation and expounds the theoretical analysis and concrete problems of the concept. Secondly, it analyzes the characteristics of administrative mediation, including its special features in system, the nature of relief and effectiveness. The second part of the article expounds the great significance and function of our country's administrative mediation system in solving rural grass-roots disputes, from promoting social harmony, promoting the transformation of government functions. The significance of shaping the service government and its specific functions in five aspects have expounded the sparkle of its system and the necessity of its application. In the third part of the article, the author summarizes the current situation of administrative mediation system in the rural grassroots mediation, and analyzes the various problems, trying to find the right remedy in the following article. Perfect the whole mechanism in order to give full play to its advantages and realize its function and value.
