论台湾地区“权力分立原则”解释的功能主义转向——以“释字第729号解释”为中心

【摘要】：台湾地区"立法院"的调阅权自确立以来,面临着诸多权力配置和权限划分问题。"司法院大法官"作成的"释字第729号解释"从立法机构与检察机关关系的角度,对立法机构调查权的行使范围和程序提出了新的要求,对台湾地区检察机关的职权进行了功能分割,也从一个侧面反映了台湾地区权力分立与制衡原则的解释方法呈现功能主义的典范转移。
[Abstract]:Since the establishment of the power of access to the "Legislative Yuan" in the Taiwan region, it has faced many problems in the allocation of power and the division of powers. "interpretation No. 729," made by the "Chancellor of the Judicial Yuan", is from the perspective of the relationship between the legislature and the procuratorial organs. New requirements have been put forward for the scope and procedures of the exercise of the investigative power of the legislature, and the functions and powers of the procuratorial organs in the Taiwan region have been divided. It also reflects the exemplary transfer of functionalism in the interpretation of the principle of separation of powers and checks and balances in Taiwan.
