嵌入与抽离:法官员额制改革的利益衡量研究

【摘要】：司法体制改革是新形势下加强依法治国建设的重要举措,法官员额制改革在其中扮演着关键角色。法官员额制改革对于推进法官队伍正规化、专业化、职业化建设,从而将优秀法官集中到办案第一线等都具有重要作用。其本质上是一场利益衡量的变革,涉及个体利益、群体利益、制度利益和社会公共利益。必须正确认识法官员额制改革的目标意义,防止认识误区和行动困境,为此,需要根据利益衡量甄别规则,厘定可相容利益位序,嵌入与改革目标一致的利益,在不相容利益间做出选择,抽离与改革目标相背离的利益,在此基础上推进实践建构。
[Abstract]:The reform of the judicial system is an important measure to strengthen the construction of governing the country according to law under the new situation, in which the reform of the post system of judges plays a key role. Therefore, it is very important to concentrate the outstanding judges on the front line of handling the case. In essence, it is a change in the measurement of interests, involving individual interests, group interests, and so on. It is necessary to correctly understand the objective significance of the reform of the post system of judges, to prevent misunderstanding and difficult position of action. Therefore, it is necessary to determine the order of compatible interests according to the rules of judging and discriminating interests. Embedding the interests consistent with the reform objectives, making a choice between the incompatible interests, pulling away the interests that deviate from the reform objectives, and advancing the practical construction on this basis.
