新刑诉法技术侦查措施的漏洞及其完善

【摘要】：新刑诉法首次对技术侦查措施作出规定,这对技术侦查措施的规范化和合法化具有重要的意义。但其规定存在着一些漏洞,如适用范围不确定、审批程序不合理、使用期限过于宽泛、检察机关没有技术侦查权等。因此,在立法中应细化使用范围及条件、规范技术侦查措施的实施主体、调整技术侦查措施的适用阶段等。
[Abstract]:The new Criminal procedure Law provides for the technical investigation measures for the first time, which is of great significance to the standardization and legalization of the technical investigation measures. However, there are some loopholes in its provisions, such as the uncertainty of the scope of application, the unreasonable examination and approval procedures, The term of use is too broad and the procuratorial organ does not have the power of technical investigation. Therefore, in legislation, the scope and conditions of application should be refined, the main body of technical investigation measures should be standardized, and the applicable stage of technical investigation measures should be adjusted.
