民事诉讼第三人类型划分新探

【摘要】：民事诉讼第三人类型划分的研究内容主要包含两方面：一是民事诉讼第三人应当分为哪些种类；二是不同类型第三人的划分标准。第三人的类型划分与第三人的参诉依据、诉讼结构、各诉讼主体之间的关系、判决形式和效力等内容密切相关，可以说是第三人制度研究中的核心问题。本文通过四个部分对第三人类型的重新划分进行探究。第一部分是对我国第三人制度演进及现状的介绍。该部分勾画了我国民事诉讼第三人制度的发展历程，并通过对现存争议的概括说明了我国先行民事诉讼制度所面临的困难处境，由于制度整体缺乏内在思路的完整性，，不能为第三人制度的研究提供任何既定的依据，故对第三人类型进行重新划分有十分的必要性。第二部分是对国外第三人制度立法例的介绍。该部分包含了前苏联、德国、日本、美国四个国家的第三人制度概述，并点明了各国制度对本文研究的启示。第三部分是对现有的第三人制度重构方案的介绍及其评价。该部分简要介绍了我国学界现存的四种代表性重构方案，并在宏观上指出了各方案共有的三种缺陷，为本文研究提供了基本思路和价值指导，即第三人制度之重构应当从制度价值的探讨出发从整体上进行。第四部分阐述了以合一确定为标准对第三人类型进行的重新划分。此部也是文章的主体部分，主要内容有第三人的类型划分模式、分类标准、合一确定的内涵和三种具体情形，并通过对有独立当事人地位第三人参诉的五个具体程序问题的阐释对本文论题做了进一步展开。本文通过以上四部分，在对现行第三人制度及相关学说进行批评的基础上，以我国所采用的规范出发型民事诉讼模式为立足点，通过对第三人制度独立价值的探讨得出了具有独创性的第三人类型划分标准，为第三人制度的研究提供了全新的思路。
[Abstract]:The research contents of the classification of the third party in civil action mainly include two aspects: the first is the classification of the third party in the civil action, the second is the standard of the classification of the third party of different types, the classification of the third party and the basis of the third party's pleading. The structure of litigation, the relationship between the subjects of litigation, the form and effect of judgment are closely related, which can be said to be the core issues in the study of the third party system. This paper probes into the re-division of the third-party type in four parts. The first part is an introduction to the evolution and present situation of the third party system in China, which outlines the development course of the third party system in civil litigation in China. And through the summary of the existing disputes, it explains the difficult situation that our country's first civil action system faces. Because the system lacks the integrity of the internal thinking, it can not provide any established basis for the study of the third party system. Therefore, it is necessary to reclassify the third party type. The second part is an introduction to the legislation of the third party system in foreign countries. This part contains an overview of the third party system of the former Soviet Union, Germany, Japan and the United States, and points out the enlightenment of the systems of various countries to the study of this paper. The third part is the introduction and evaluation of the existing third party system reconstruction scheme. This part briefly introduces the existing four representative reconstruction schemes in Chinese academic circles, and points out three common defects in each scheme. It provides the basic thinking and value guidance for this study, that is, the reconstruction of the third party system should be carried out from the perspective of the system value. Part 4th expounds the redivision of the third party type with the criterion of unity determination. This part is also the main part of the article, which mainly includes the classification mode and classification standard of the third party. The connotation and three kinds of concrete circumstances of unified determination, and through the interpretation of the five specific procedural issues of independent party status, the third ginseng litigation, this paper makes a further development of the topic. Through the above four parts, on the basis of criticizing the current third party system and related theories, this paper bases on the standardised civil litigation mode adopted in our country. Through the discussion of the independent value of the third party system, the author obtains the original criteria for the classification of the third party type, and provides a new way of thinking for the study of the third party system.
