公立高校教师人事争议诉讼现状及特征研究——基于134份裁判文书的实证视角

【摘要】:以"中国裁判文书网"的134份二审裁判文书为研究对象,分析了公立高校教师人事争议诉讼的现状和特征。研究表明,近年人事争议诉讼数量呈上升趋势,高发于56-65岁的教师,以解聘类纠纷居多。但因受案范围狭窄,很多诉求未进入实体审理环节即告终结。教师胜诉率较低,极大影响了教师维权的积极性。基于实证研究结论,建议通过明确受案范围、加强仲裁和诉讼的衔接来完善教师人事争议的司法救济途径。
[Abstract]:The present situation and characteristics of personnel dispute litigation of teachers in public colleges and universities are analyzed with 134 documents of the second instance of China judgment documents Network as the research object. The research shows that the number of personnel disputes litigation has been on the rise in recent years, with a high number of teachers aged 56 to 65 years old. However, because of the narrow scope of the cases, many appeals end without entering the substantive trial process. The teachers' success rate is low, which greatly affects the enthusiasm of teachers' rights. It is suggested that the judicial remedies for teachers' personnel disputes should be improved by clarifying the scope of accepting cases and strengthening the connection between arbitration and litigation.
